DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
Applicant's election with traverse of Group I in the reply filed on 8/21/2026 is acknowledged. The traversal is on the ground(s) that the subject matter of all the claims is sufficiently and that the search and examination of the entire application could be made without serious burden. This is not found persuasive because although the subject matter of the elected group may be encompassed by the remaining claims, the subject matter of the remaining claims is not necessarily required and encompassed by the elected claims. Therefore, the requirement is still deemed proper and is therefore made FINAL. Claims 3-17 are withdrawn. Claims 1-2 are pending and examined below.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-2 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by JP37933906.
Regarding claim 1, JP37933906 discloses a three-point supporting anchor integrated liner (Figs. 1-5) having one end secured to a slab (approximate 13) under machine foundation reinforced concrete (7) and another end including a screw portion (25) and a liner portion (10), the screw portion having a diameter larger than a shaft diameter (22) and projecting to an upper surface of the machine foundation reinforced concrete (7), the liner portion being screwed with the screw portion to form a mounting surface for a plate having an upper surface on which a machine is installed or for the machine and allowing adjustment of an installation height of the plate or the machine, the three-point supporting anchor integrated liner comprising a first shaft (22) that is longer than a height difference dimension between a top rebar (5) of a foundation reinforcement cage buried in the machine foundation reinforced concrete and a slab top (11); a second shaft (21) that extends in a direction intersecting with the first shaft (22) and allows both ends to intersect with and be tied to the foundation reinforcement cage (5, the Examiner considers the second shape capable of being adjusted where both ends would be capable of intersecting tied to the cage); and a coupling portion (23) that couples the second shaft (21) to the first shaft in a state where the second shaft intersects with the first shaft (Figs. 1-5).
Regarding claim 2, JP37933906 discloses one or more of the second shafts (21) are mounted to the first shaft and supported by the coupling portion (23) to move up and down along a longitudinal direction of the first shaft and be able to move in a left and right direction with the first shaft as a center. The Examiner considers the second shaft capable of moving left and right to a degree.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
