CTNF 18/832,706 CTNF 84303 DETAILED ACTION Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Specification The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed. The title should be specific and descriptive, avoiding generic words. In this instance, the title currently recites: “Terminal, Radio Communication Method, and Base Station” which is not specific and descriptive. Response to Amendment Acknowledgement is made in that Claims 1-4 have been cancelled and Claims 5-8 have been added in the instant application presented herein. Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15 AIA Claim s 6-8 are rejected under 35 U.S.C. 102( a)(1 ) as being anticipated by Gao et al. (WO 2020/144602 A1) (hereinafter as Gao) (the reference was cited and included with the IDS dated 24 July 2024) . Regarding Claim 6. Gao teaches a radio communication method for a terminal (WD), comprising: receiving a channel state information (CSI) report configuration indicating, as a codebook type, a codebook for coherent joint transmission (CJT) (CSI reporting, p. 1, line 15, p. 13, line 9 to p. 14, line 2, p. 16, lines 11-23, p. 36, line 31 to p. 37, line 10, p. 44, line 27 to p. 45, line 5, p. 49, lines 30-32); and controlling to report, in a single CSI report, a precoding matrix indicator (PMI) for X channel measurement resources (CMRs) configured by the CSI report configuration (p. 1, line 15, p.2, lines 11-19, p. 13, line 9 to p. 14, line 2, p. 16, lines 11-23, p. 36, line 31 to p. 37, line 10, p. 44, line 27 to p. 45, line 5, p. 49, lines 30-32, p.3, lines 13-23, p.7, lines 9-10, disclose PMI and CSI-RS can be c onfigur ed to be transmitted in certain REs in a slot and/or certain slots of a channel). Regarding Claim 5, this apparatus (terminal) claim comprises limitations(s) substantially the same, as those discussed in claim 6 above, same rationale of rejection is applicable. Regarding Claim 7, this apparatus (base station) claim comprises limitations substantially the same, as those discussed in claim 6 above, same rationale of rejection is applicable. Gao further teaches a base station (p.29, lines 13-29). Regarding Claim 8, this system claim comprises limitations(s) substantially the same, as those discussed in claim 6 above, same rationale of rejection is applicable. Gao further teaches a receiver (radio device), a processor, and a base station (p.29, lines 13-29).
