Specification The lengthy specification has not been checked to the extent necessary to determine the presence of all possible minor errors. Applicant’s cooperation is requested in correcting any errors of which applicant may become aware in the specification. The disclosure is objected to because of the following informalities: p. 45 refers to Fig. 2D but there is no Figure 2D, nor any absorption spectra shown in any Figures (p. 37 line 21 as originally filed). The drawings and specification are not in agreement as presented in the drawing objections above. The specification will require amendments to correct all the issues raised above. See past specification objections as the substitute specification is not entered. Appropriate correction is required. The substitute specification filed 7/30/2026 has not been entered because it does not conform to 37 CFR 1.125(b) and (c) because: the amendments are not consistent with 1.121 as the clean version is not clean (see page 6), and not all changes were properly tracked in the marked version (see page 24), and changes do not match (see page 49 of marked and pages 48-49 of clean), please fix and resubmit. Claim Interpretation The following is a quotation of 35 U.S.C. 112(f): (f) Element in Claim for a Combination. – An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. The following is a quotation of pre-AIA 35 U.S.C. 112, sixth paragraph: An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. The claims in this application are given their broadest reasonable interpretation using the plain meaning of the claim language in light of the specification as it would be understood by one of ordinary skill in the art. The broadest reasonable interpretation of a claim element (also commonly referred to as a claim limitation) is limited by the description in the specification when 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is invoked. As explained in MPEP § 2181, subsection I, claim limitations that meet the following three-prong test will be interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph: (A) the claim limitation uses the term “means” or “step” or a term used as a substitute for “means” that is a generic placeholder (also called a nonce term or a non-structural term having no specific structural meaning) for performing the claimed function; (B) the term “means” or “step” or the generic placeholder is modified by functional language, typically, but not always linked by the transition word “for” (e.g., “means for”) or another linking word or phrase, such as “configured to” or “so that”; and (C) the term “means” or “step” or the generic placeholder is not modified by sufficient structure, material, or acts for performing the claimed function. Use of the word “means” (or “step”) in a claim with functional language creates a rebuttable presumption that the claim limitation is to be treated in accordance with 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. The presumption that the claim limitation is interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is rebutted when the claim limitation recites sufficient structure, material, or acts to entirely perform the recited function. Absence of the word “means” (or “step”) in a claim creates a rebuttable presumption that the claim limitation is not to be treated in accordance with 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. The presumption that the claim limitation is not interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is rebutted when the claim limitation recites function without reciting sufficient structure, material or acts to entirely perform the recited function. Claim limitations in this application that use the word “means” (or “step”) are being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, except as otherwise indicated in an Office action. Conversely, claim limitations in this application that do not use the word “means” (or “step”) are not being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, except as otherwise indicated in an Office action. This application includes one or more claim limitations that do not use the word “means,” but are nonetheless being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, because the claim limitation(s) uses a generic placeholder that is coupled with functional language without reciting sufficient structure to perform the recited function and the generic placeholder is not preceded by a structural modifier. Such claim limitation(s) is/are: “a computing unit…configured to” in claim 2. Because this/these claim limitation(s) is/are being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, it/they is/are being interpreted to cover the corresponding structure described in the specification as performing the claimed function, and equivalents thereof. If applicant does not intend to have this/these limitation(s) interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, applicant may: (1) amend the claim limitation(s) to avoid it/them being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph (e.g., by reciting sufficient structure to perform the claimed function); or (2) present a sufficient showing that the claim limitation(s) recite(s) sufficient structure to perform the claimed function so as to avoid it/them being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. Claim Objections Claims 9, 11-12, 20 are objected to because of the following informalities: claim 9 “claim 1wherein” should read “claim 1 wherein”; claim 20 should contain a conjunction in the closed list set forth prior to the last element of the closed list; claims 11-12 “antigen is selected from” should delete “is” or include “and is” or similar language in each claim. Appropriate correction is required. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding claim 1, the limitations render the claim indefinite for the following reasons: It is unclear whether a solvent is a required element or merely an inferenced structure. While the limitations “a second container (5) for a solvent,” sets forth that the solvent is not required, the remaining limitations which define the solvent, define functions of the solvent with other structures, and require the solvent to be able to process optical changes makes it unclear what the metes and bounds of the claim are. Including “wherein nanoparticles are dissolved in the solvent and the nanoparticles are linked to antibodies, further wherein a change of optical properties of the solvent is detectable upon contact between the antibodies and matching antigens”, “the second container (5) is configured to incorporate the first container (1), wherein the filter (6) of the first container (1) contacts the solvent of the second container (5) in the measuring cell, wherein during incorporating of the second container (5) into the first container (1), a sealing between the first and second containers forces the solvent in the second container (5) to get pushed through the filter (6) of the first container (1) and flushes the filter and dissolves collected aerosols out of the filter into the solvent, wherein the light source (2) irradiates the solvent and the light sensor (4) is arranged to detect a change of optical properties, and the system comprises an alarm device adapted to emit an alarm signal upon detection of the change of optical properties.”. As such, it is not clear whether the solvent is a required element of the system or is not a required element of the system as the claims have conflicting limitations which refer to both the feature as required and as the feature not required. This issue is further exasperated in the dependent claims which directly further limit aspects related to these features such that it is not clear if any of the aspects are limiting or further limit inferenced features which are outside the metes and bounds of the claimed system/methods based on said system. This issue prevents the application of speculative prior art rejections due to the uncertainty and assumptions/presumptions which would be required to make such scope determinations, In re Steele, MPEP 2173.06. Second, where there is a great deal of confusion and uncertainty as to the proper interpretation of the limitations of a claim, it would not be proper to reject such a claim on the basis of prior art. As stated in In re Steele, 305 F.2d 859, 134 USPQ 292 (CCPA 1962), a rejection under 35 U.S.C. 103 should not be based on considerable speculation about the meaning of terms employed in a claim or assumptions that must be made as to the scope of the claims. Regarding claim 13, which depends on claim 1, claim 1 refers to “antibodies, further wherein a change of optical properties of the solvent is detectable upon contact between the antibodies and matching antigens”, claim 13 refers to “said antigens…said antigen…said antigen with the antibody… an antigen” which renders the claim indefinite. It is not clear if these are all the same or different terms for antigen/antibody in singular and plural forms. This makes the metes and bounds of the claim unclear, which renders the claim indefinite. Further claim 13 recites the features “(d) contacting said antigen with the antibody, wherein the contact causes a change of optical properties of the solvent; (e) determining a change of optical properties with the light sensor (4) and transferring data as to said change of optical properties to a computing unit, (f) calculating concentration of an antigen based on said change of optical properties of the solvent,” which render the claim indefinite in view of claim 1 requirement of "detect a change of optical properties,". It is not clear if these are all the same or different terms. This makes the metes and bounds of the claim unclear, which renders the claim indefinite. It suggested to rewrite claim 13 in independent form with the structures of claim 1 amended into claim 13 instead of the current strategy of having the method depend directly from the system. Regarding claim 14, the limitations “triggering an alarm device to produce a visual and/or an acoustic signal when the first parameter is greater than or identical to a pre-set value” renders the claim indefinite in view of claim 1 requirement of claim 1 “the system comprises an alarm device adapted to emit an alarm signal upon detection of the change of optical properties”. It is not clear if these are the same or different structures. This makes the metes and bounds of the claim unclear, which renders the claim indefinite. The dependent claims are rejected for depending on a rejected claim. Response to Arguments The examiner acknowledges applicant’s submission of amendments to the claims drawings, and specification filed 7/30/2026; and IDS filed 5/15/2026 and 7/30/2026. Applicant’s arguments regarding the objections to the specification, drawings, and claims have been fully considered and are partially persuasive where prior objections are removed. The various element numerals raised were either not addressed, or remain due to the nonentry of the substitute specification. Applicant’s arguments regarding the rejections of the claims under 35 U.S.C. 112(b) have been fully considered and are partially persuasive due to the amendments to the claims. Applicant argues the amendments correct all issues, the examiner respectfully disagrees as changing “suitable for a solvent” to “for a solvent” does not change the issue as to whether the solvent is required or not as raised above. If the feature is required then the claim limitation should be “a second container containing a solvent”. The rejections are respectfully maintained as presented above. Applicant’s arguments regarding the claim interpretation have been fully considered but is not persuasive. Contrary to applicant statement, only claim 2 invokes 35 U.S.C. 112(f), and claim 2 is unamended. As such, the invocation remains. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. US 9945878, US 9709582, US 10178963, US 11187711, US 2023/0104609, US 20140180156, US 2023/0320623 teaches structures for collecting, filtering, and/or light/colorimetry sensing breath, . No prior art rejections have been applied to the claims for the reasons explained above in the 112(b) rejections, In re Steele. MPEP 2173.06. Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
