Information Disclosure Statement
The information disclosure statement (IDS) submitted on 12/04/2024, 09/22/2025 and 06/30/2026 are in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(B) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-14, 17 and 19-23 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention. Regarding claim 1, claim 1 recites:
“A data transmission method, executed by a relay device in an intelligent collecting system, wherein the intelligent collecting system comprises a host device and the relay device independently deployed within short range; the relay device comprises a first network module and a second network module, the first network module is configured to access a first network, and the second network module is configured to access a second network; and the method comprises:
receiving first data transmitted by the host device, the first data comprising environmental data collected by the host device; selecting the first network or the second network as an access network for accessing a wide area network according to a quality-parameter network quality of at least one of the first network and the second network; and transmitting second data to a cloud platform connected with the wide area network through the access network, the second data comprising the environmental data” is considered indefinite.
As its not clear whether the claimed invention is directed towards a method or a system. Second, its not clear where the preamble ends. Further, which entity receives the first data (is it intelligent collecting system or relay device) and which entity transmits the second data. Further the second data comprising the environmental data (is it same as first data?). Examiner recommend to clarify the underlined limitations.
Similar rejection is applied to independent claims 14 and 17
An appropriate correction is required.
Further claims 1-3, 14, 17, 20, 21 recites “first network module/second network module” imitations that are considered to invoke section 112(f) (pre-AIA , section 112, sixth paragraph), however, some of these limitations do not have corresponding structure described in the specification. For example, specification (US 2016/0181540 A1), paragraphs 0053-0054 disclose The first network module 3021 is a wireless module configured to perform data transmission etc. but neither paragraph discusses any specific structure tied to the modules. As a result, it is not clear what structure the corresponding “modules” should have. Thus, one skilled in the art would not be apprised of what applicant regards as the invention, and the metes and bounds of the claims cannot be fully determined. For purposes of examination, if the function, as claimed, is performed by a device or component, the examiner considers this sufficient to teach the limitations as they are claimed and described.
An appropriate correction is required.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure:
Tokuyasu et al. (US-8284746-B2) discloses FIG. 1, a wireless terminal 21 is connected through a wireless relay device 1 managed by a user of the wireless terminal 21 to one wireless access point (AP) of a plurality of access networks 11, 12 and 13 with different wireless interfaces and is further connected over one of the access networks 11, 12 and 13 to a backbone network 10 (Fig. 1).
Raniere et al. (US-20140280715-A1) discloses A method and system for remotely controlling networked devices in approximately real time, by using two or more nodes and a host device. The network achieves real time speeds by segmenting requests and commands to the host device into packet segments then distributing the packet segments through a network of nodes. Each individual node contributes resources to a resource pool which allows for increased data throughput, greater processing speeds, increased memory and storage space (Abstract).
Ormson et al. (US-20040106401-A1) discloses invention relates to improvements in standby time in a dual mode mobile communication device such as a mobile telephone or PDA with a cellular connection (Fig. 2).
Mula et al. (US-20230047454-A1) discloses A relay device is provided that may identify a quantity of empty data byte locations in a data buffer of the relay device. The relay device may receive an indicator associated with transmitting data packets. The relay device may pause or enable a lossless flow of data between the relay device, a host device, and a peer device based on the quantity of empty data byte locations, the indicator, or both. The relay device may include a first data interface coupled with a peer device, a second data interface coupled with a host device, a data buffer configured to store data packets received from the host device, and a state machine that enables a lossless transmission of data between the host device and peer device. The state machine may transmit a pause frame to the host device based on a data buffer utilization reaching a data storage capacity (Abstract).
BHATTACHARYA et al. (US-20190206228-A1) discloses system includes a first electronic device, which is configured to detect one or more physiological and/or behavioural characteristics of a first user. Thereafter, one or more attributes associated with the detected one or more physiological and/or behavioural characteristics of the first user are determined. One or more media items are retrieved from a plurality of media items in accordance with the determined one or more attributes. The retrieved one or more media items are played back at the first electronic device for the first user and/or a pre-registered second electronic device for a second user (Fig.1).
