CTNF 18/834,813 CTNF 87364 DETAILED ACTION Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 103 07-20-aia AIA The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. 07-21-aia AIA Claim (s) 1, 10, 19 and 20 are rejected under 35 U.S.C. 103 as being unpatentable over Baecker et al. (U.S. 2021/0285927, hereafter referred to as Baecker) . Regarding claims 1, 10, 19 and 20, Baecker teaches a method and system, comprising: allowing one or more fluids from a subterranean formation to flow through a formation testing tool disposed in a wellbore of a well (see para. 0027); determining, via the formation testing tool 40, data relating to one or more properties of the one or more fluids (see para. 0028), communicating the data relating to the one or more properties of the one or more fluids from the formation testing tool to a surface control system 50 (see para. 0031); and determining hydrocarbon content of the one or more fluids and/or gas emissions relating to the one or more fluids based at least in part on the data relating to the one or more properties of the one or more fluids (see para. 0015, 0028). Baecker does not explicitly teach determining, via the surface control system , hydrocarbon content of the one or more fluids and/or gas emissions relating to the one or more fluids based at least in part on the data relating to the one or more properties of the one or more fluids. Baecker does further teach the fluid analysis unit 40 includes a sampling device 42 connected to one or more of various instruments that may be used to determine the content of borehole fluid. Examples of such instruments include a mass spectrometer and/or a gas chromatography test device to determine the amount or volume of hydrocarbon and non-hydrocarbon fluids in the borehole fluid. The fluid analysis unit 40 can also include a cuttings analysis system for measuring relative amounts of minerals and other formation materials in the cuttings. The analysis, in one embodiment, includes isotope ratio analysis for various natural gases. It is noted that the instruments or devices that may be used to determine fluid and/or mud gas content are not limited to the above examples (see para. 0028). However, it would have been obvious to one of ordinary skill in the art before the effective filing date to modify the device of Baecker as an obvious matter of design choice since applicant has not disclosed that this configuration solves any stated problem or is for any particular purpose and it appears that the invention would perform equally well with fluid analysis unit 40 determining hydrocarbon content as opposed to the surface processing unit 50 determining the hydrocarbon content. Regarding claim 2, Baecker further teaches determining, via the formation testing tool, how many different fluids are flowing through the formation testing tool (see para. 0027, ‘ Sensors for measuring borehole fluid parameters (including mud gas and/or other fluids) may be included with surface equipment. In one embodiment, surface fluid sensors are incorporated in or connected to a fluid analysis unit 40 that includes components for sampling and analyzing borehole fluid. Borehole fluid may include various types of fluid and materials, including fluid circulated through the borehole 12 (e.g., drilling mud), formation fluid entering the borehole 12 (e.g., water, hydrocarbons, gases, etc.), mud gases, and cuttings from the drilling process ’); mapping, via the formation testing tool, a flowrate to a fluid density measurement for each fluid of the one or more fluids; summing, via the formation testing tool, flowrates of similar fluids of the one or more fluids, and converting, via the formation testing tool, the summed flowrates from volume rates to mass rates by multiplying the summed volume rates to the mapped fluid density measurement . Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim s 2-9 and 11-18 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
