Office Action

§112
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-6 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The claims are replete with indefinite language too numerous to mention specifically, and should be revised carefully. For example only, in claim 1, line 1, “Electronic” should be replaced with --An electronic--. In claim 1, line 1, “automatic” should be replaced with --an automatic--. In claim 1, the phrases “the volume” on line 2, “the control valve” and “the pressure line” on line 2, “the lower part” on line 4, “the flow of pressurized fluid”, “the inlet and outlet” and “the fluid” on line 5, “the longitudinal plane” and “the flow of fluid” on line 6 lack proper antecedent basis. In claim 1, the phrases “line the” on line 3, “this same automatic …” on lines 7-8, and “housing. The” on line 13 are incomplete and indefinite. In claim 1, the phrases “the receiver”, “the charging station” on lines 22-23 and “the fluid flow valve” line 24 lack proper antecedent basis. In claim 1, the phrases “a valve” on line 30, “a connecting rod” on line 31, “a pin” on lines 32 and 35, “a slide” on line 34, “a spring” on line 36, “a cam pawl” on line 37, “a torsion spring” on line 38, “a solenoid” and “stem” on line 39 are double recitations. In claim 2-6, line 1, “Electronic” should be replaced with --The Electronic--. In claims 2-3 and 6, line 2, the phrase “the first claim” should be replaced with --claim 1--. In claim 3, the phrases “a manually operated trigger”, “a connecting rod”, “a pin” (two places), “a slide”, “a spring” are double recitations. In claim 3, the phrases “housing. The”, “fluid. The”, and “released. When” are incomplete and indefinite. In claim 4, “the third claim” should be replaced with --claim 3--. In claim 4, the phrase “the slide described” is confusing and indefinite because it has no clear meaning. In claim 4, the phrases “a cam-shaped pawl”, “a torsion spring”, “a rod”, and “a solenoid” are double recitations of claims 1 and 3. In claim 5, “the fourth claim” should be replaced with --claim 4--. The applicant is required to make corrections to the claims wherever appropriate in order to clarify same. If Applicant continues to prosecute the application, revision of the specification and claims to present the application in proper form is required. While an application can be amended to make it clearly understandable, no subject matter can be added that was not disclosed in the application as originally filed. Allowable Subject Matter Claims 1-6 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. This application is in condition for allowance except for the above matters. Prosecution on the merits is closed.
