DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Election/Restrictions Applicant’s election without traverse of Group II, claims 4 and 5 in the reply filed on 6/30/26 is acknowledged. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 4-5 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Kim et al. (US8989571B2). Regarding claim 4, Kim et al. discloses A control signal receiving device (Fig. 7; SV detector 700) comprising: a decoder (Fig. 7; the DSP circuit 714) configured to decode a control signal based on a polarization state of an optical signal (Fig. 7; Column 16, lines 51-57; Column 17, lines 29-32; The signal processing circuit 714 may be configured to determine a difference between the power of the horizontal/vertical polarization components, a difference between the power of the +/-forty-five degree polarization components, and/or a difference between the power of the left/right circular polarization components as received from the polarimeter 703. The signal processing circuit 714 configured to perform demodulation of complementary power modulation of X' and Y' polarizations of the tapped optical signal 701) for carrying a main signal (Fig. 5; Fig. 7; the transmitted optical signal by the PBC 514 carries main data and supervisory data as shown. The supervisory (SV) data 716 is recovered from the tapped optical signal 701). Regarding claim 5, Kim et al. discloses The control signal receiving device according to claim 4, as described and applied above, comprising: a compensator (Fig. 5; the PR 517a and PR517b) configured to compensate for polarization of the optical signal (Fig. 5; Fig. 8; Column 18, lines 1-6; At step 806, the optical transmitter may decrease a second power level of a second polarization component of the optical signal based on the supervisory data. The decrease of the second power level may be substantially the same as the increase of the first power level such that a total power of the optical signal may be substantially constant); and a modulator configured to perform polarization modulation of the optical signal (Fig. 5; Column 11, lines 33-35; the optical transmitter 502 may be configured to perform the complementary power modulation using polarization rotators 517a and 517b) whose polarization is compensated by a new control signal (Fig. 5; Fig. 8; Column 18, lines 1-6; At step 806, the optical transmitter may decrease a second power level of a second polarization component of the optical signal based on the supervisory data).
