Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.
Claim 14 is rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter. This is directed towards "a computer program”. Please note that under the broadest reasonable interpretation of the claims when read in light of the specification, the recited “a computer program” can be software per se. Software per se is not patent eligible. See MPEP 2106.03. Applicant is advised to use “non-transitory computer readable storage medium”.
Claim Objections
Claim 9 objected to because of the following informalities:
Claim 9 depends on claim 7. Claim 7 is cancelled. In this office action, claim 9 is examined as depending on claim 8.
Appropriate correction is required.
Allowable Subject Matter
The following is an examiner’s statement of reasons for allowance:
While NGUYEN (EP 2597539) discloses obtaining an optimized parameter set using a prediction model; Chalermkraivuth (US 2005/0187844) discloses perform multiple optimization process and generate a result by fusing interim results; Risbeck (US 2022/0011731) disclose selecting from a sets of optimization results based on values of control objective; none of these references taken either alone or in combination with the prior art of record disclose:
(Claim 1) computing differences for pairs of the solution vectors; and on the basis of the differences, selecting at least one of the solution vectors for use in controlling the technical system, wherein the selection of the one of the solution vectors includes executing a voting scheme in which clusters of the solution vectors are formed and the solution vector to be used is selected from the largest one of the clusters.
