Claims 1-30 are pending.
Claims 2-7, 11-16, 20-21, 24, 26-27 and 30 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
Claims 1, 8, 9, 10,17, 18, 19,22, 23, 25, 28, 29 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by KHOSHNEVISAN et al. WO 2022/067866[herein after KHOSHNEVISAN].
As per claims 1,10, 19, and 25 KHOSHNEVISAN discloses: A method of wireless communication at a user equipment, UE, (Fig. 6; Fig. 5) the method comprising:
receiving, from a network entity, a first downlink control information, DCI (Fig. 6: (610); PAR. 0088: "As shown in Fig. 6, in some aspects, process 600 may include receiving a DCI message that includes a first field indicating a first TPMI index and a quantity of transmission layers and a second field indicating a second TPMI index (block 610)."; Par. 0068: "As shown by reference number 510, the UE 120 may receive a DCI message. For example, the UE 120 may receive a single DCI message from the first TRP 505-1 or the second TRP 505-2 (or another TRP or base station). The DCI message may schedule a first set of repetitions of a PUSCH transmission (e.g., a transport block) and a second set of repetitions of the PUSCH transmission);
transmitting a first uplink, UL, transmission scheduled by the first DCI (see par. 0091: "In a first aspect, process 600 includes transmitting one or more repetitions of the first set of repetitions using the first precoding matrix); and
transmitting a second UL transmission after the first UL transmission (see par. 00 91: "In a first aspect, process 600 includes transmitting and one or more repetitions of the second set of repetitions using the second precoding matrix."; Fig. 5 showing the second repetition being precoded based on the second TPMI is transmitted after the first scheduled repetition using the first TPMI.), a precoding scheme of the second UL transmission being determined based on at least in part the first DCI (see par.0089: "As further shown in Fig. 6, in some aspects, process 600 may include determining a first precoding matrix for transmitting a first set of repetitions of a PUSCH transmission based at least in part on the first TPMI index and the quantity of transmission layers, and a second precoding matrix for transmitting a second set of repetitions of the PUSCH transmission based at least in part on the second TPMI index and the quantity of transmission layers (block 620)).
As per claim 8, and 17, 22 and 28 KHOSHNEVISAN discloses the method of claim 1, wherein the precoding scheme comprises at least one of SRS resource indicator, transmit precoder matrix indicator, or modulation and coding scheme MCS(see par. 0061).
As per claim 9, and 18 , 23 and 29 KHOSHNEVISAN discloses the method of claim 1, further comprising at least one of: transmitting, to the network entity, a request to stop a process for predicting the precoding scheme(see par. 0065, 0082); or receiving, from the network entity, a command to start or stop the process for predicting the precoding scheme(see par. 0082).
