Office Action

§102 §103 §112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The information disclosure statements (IDS), submitted on 8/27/2024 and 1/27/2026, are being considered by the examiner. Objections Claims 3, 11, 18 and 26 are objected. The claim limitation “an ID of the ML model” should be read “an identification of the ML model”. Appropriate corrections are required. The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, “non-ML based precoder matrix indicator (PMI) codebooks”, “CSI reference signal”, “an ML-based CSI report”, “an ID of the ML model”, must be shown or the feature(s) must be canceled from the claims 1-30. No new matter should be entered. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejection – 35 U.S.C. § 112 The following is a quotation of 35 U.S.C. 112(b): (B) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of pre-AIA 35 U.S.C. 112, second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 3 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter, which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention. Claim 3 recites the limitation "the same CSI reference signal ". There is insufficient antecedent basis for this limitation in the claim. Therefore, the claim(s) is/are indefinite and is/are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention. Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102 of this title, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The factual inquiries set forth in Graham v. John Deere Co., 383 U.S. 1, 148 USPQ 459 (1966), that are applied for establishing a background for determining obviousness under pre-AIA 35 U.S.C. 103(a) are summarized as follows: 1. Determining the scope and contents of the prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or nonobviousness. This application currently names joint inventors. In considering patentability of the claims under pre-AIA 35 U.S.C. 103(a), the examiner presumes that the subject matter of the various claims was commonly owned at the time any inventions covered therein were made absent any evidence to the contrary. Applicant is advised of the obligation under 37 CFR 1.56 to point out the inventor and invention dates of each claim that was not commonly owned at the time a later invention was made in order for the examiner to consider the applicability of pre-AIA 35 U.S.C. 103(c) and potential pre-AIA 35 U.S.C. 102(e), (f) or (g) prior art under pre-AIA 35 U.S.C. 103(a). Claims 6, 15, 22, and 30 are rejected under 35 U.S.C. 103 as being unpatentable over Echigo (US Patent Application Publication US 2025/0227498 A1), (“Echigo”), in view of Cella et al. (US Patent Application Publication 2022/0366494 A1), (“Cella”). Regarding claims 6, 15, 22, 30, Echigo meets the claim limitations as set forth in claims 1, 8, 16, and 24. Echigo further meets the claim limitations as follow. wherein the indication (In the present disclosure, UCI, CSI reporting, CSI feedback, feedback information, feedback bit, and the like may be interchangeably interpreted. In the present disclosure, a bit, a bit string, a bit sequence, a sequence, a value, information, a value obtained from a bit, information obtained from a bit, and the like may be interchangeably interpreted) [Echigo: para. 0088]; Figs. 1, 4) comprises a deactivation (An actor stage may include an action trigger (for example, determining whether to trigger action to another entity), feedback (for example, feeding back information required for training data/inference data/performance feedback), and the like) [Echigo: para. 0038] of the ML model (In the present disclosure, the UE/BS may input channel state information, a reference signal measurement value, and the like to the ML model) [Echigo: para. 0050]. Echigo does not explicitly disclose the following claim limitations (Emphasis added). wherein the indication comprises a deactivation of the ML model. However, in the same field of endeavor Cella further discloses the deficient claim limitations as follows: wherein the indication comprises a deactivation (the conditioning of an activation / deactivation of a system) [Echigo: para. 0275]. It would have been obvious to one with an ordinary skill in the art before the effective filing date of the claimed invention to modify the teachings of Echigo with Cella to program the system to implement of Cella’s method. Therefore, the combination of Echigo with Cella will enable the system to determine data resources and their configuration in a model, which help to launch a new service [Cella: Abstract].
