Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 3, 7-8, 11, and 15-16 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claim 3, it is unclear if “the first glass composition includes CaO and MgO in an amount smaller than 10 wt% in total” is referring to either, both, or the sum of CaO and MgO.
Regarding claim 7, it is unclear if “the second glass composition includes CaO and MgO in an amount smaller than 10 wt% in total” is referring to either, both, or the sum of CaO and MgO.
Regarding claim 8, it is unclear what “SiO3” is. SiO3 is not represented in claims 6 or 1, from which claim 8 depends, and SiO3 is not a standard glass ingredient. It appears as if this should recite SiO2.
Regarding claim 11, it is unclear if “the first glass composition includes CaO and MgO in an amount smaller than 10 wt% in total” is referring to either, both, or the sum of CaO and MgO.
Regarding claim 15, it is unclear if “the second glass composition includes CaO and MgO in an amount smaller than 10 wt% in total” is referring to either, both, or the sum of CaO and MgO.
Regarding claim 16, it is unclear what “SiO3” is. SiO3 is not represented in claims 6 or 1, from which claim 8 depends, and SiO3 is not a standard glass ingredient. It appears as if this should recite SiO2.
Allowable Subject Matter
Claims 1-2, 4-6, 9-10, 12-14, and 17 are allowed.
Claim 1 is directed towards a detergent glass composition comprising: a mixture of a first glass composition and a second glass composition, wherein the first glass composition includes: based on 100wt% of the first glass composition, 60 to 70wt% of B2O3; 1 to 4wt% of Al2O3; 5 to 9wt% of CaO; and 15 to 30wt% of K2O and Na2O in total, wherein the second glass composition includes: based on 100wt% of the second glass composition, 65 to 70wt% of SiO2; 5 to 9wt% of CaO; and 21 to 28wt% of K2O and Na2O in total.
Claim 9 is directed towards a method for preparing detergent glass powder, wherein a first glass composition is prepared, including: based on 100wt% of the first glass composition,60 to 70wt% of B2O3; 1 to 4wt% of Al2O3; 5 to 9wt% of CaO; and 15 to 30wt% of K2O and Na2O in total, wherein a second glass composition is prepared, including: based on 100wt% of the second glass composition, 65 to 70wt% of SiO2; 5 to 9wt% of CaO; and 21 to 28wt% of K2O and Na2O in total, wherein the method includes :mixing and stirring the first glass composition with the second glass composition to form a glass composition; melting the glass composition; cooling the melted glass composition; and grinding the cooled glass.
The closest prior art is Fechner et al. (US20040253321, hereinafter referred to as Fechner). Fechner is directed towards a glass powder (see Fechner at the Abstract) comprising 20-80 wt. % SiO2, 0-40 wt. % Na2O, 0-40 wt. % K2O, 0-40 wt. % Li2O, 0-40 wt. % CaO, 0-40 wt. % MgO, 0-40 wt. % Al2O3, 0-1 wt. % P2O5, 0-40 wt. % B2O3 and 0-10 wt. % ZnO (see Fechner at the Abstract). However, per instant claims 1 and 9, Fechner fails to disclose or make obvious a first glass composition is prepared, including: based on 100wt% of the first glass composition,60 to 70wt% of B2O3; 1 to 4wt% of Al2O3; 5 to 9wt% of CaO; and 15 to 30wt% of K2O and Na2O in total, wherein a second glass composition is prepared, including: based on 100wt% of the second glass composition, 65 to 70wt% of SiO2; 5 to 9wt% of CaO; and 21 to 28wt% of K2O and Na2O in total.
All claims not specifically addressed are allowed due to their dependence on an allowed claim, or because they contain all of the allowable limitations of an allowed claim.
