Office Action

§102 §112
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. In claim 14, “the first information” there is insufficient antecedent basis for this limitation in the claim. However, appropriate correction is required. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 14-23 is/are rejected under 35 U.S.C. 102 as being anticipated by Zhou US 20240314590 14. A method for performing a sensing procedure by a first station (STA) in a wireless LAN system, the method comprising: receiving, from a second STA, at least one sensing measurement setup request frame requesting at least one sensing measurement setup (Zhou: fig. 6 - receives the sensing measurement setup request frame); transmitting, to the second STA, at least one sensing measurement setup response frame in response to the at least one sensing measurement setup request frame (Zhou: fig. 6 - replies with a sensing measurement setup response frame); and transmitting a sensing measurement setup termination frame to the second STA or receiving the sensing measurement setup termination frame from the second STA (Zhou: fig. 4, 9-10 - transmits the sensing measurement setup termination frame), wherein the sensing measurement setup termination frame includes i) specific information indicating whether the first STA or the second STA requests to terminate at least one sensing measurement setup (Zhou: fig. 11 - the sensing measurement setup termination request frame may include a reason code field (Reason Code) for indicating the reason for requesting to terminate the measurement setup, and the reason code may be 1 byte in length), and ii) a measurement setup ID (identifier) field based on the first information (Zhou: fig. 5, 11B - measurement setup ID field carries the first measurement). 15. The method of claim 14, wherein the specific information is indicated by a specific subfield included in the sensing measurement setup termination frame, based on the specific subfield value being set to 0, the specific information indicates that the first STA or the second STA does not request to terminate the at least one sensing measurement setup (Zhou: fig. 4A - For example, Sensing Measurement Setup Termination from Responder = 0 represents that the sensing responder is not allowed to initiate the sensing measurement setup termination), and based on the specific subfield value being set to 1, the specific information indicates that the first STA or the second STA requests to terminate the at least one sensing measurement setup (Zhou: fig. 4A - For example, Sensing Measurement Setup Termination from Responder =1 represents that the sensing responder is allowed to initiate the sensing measurement setup termination). 16. The method of claim 15, wherein based on the specific subfield value being set to 1, the Measurement Setup ID field is reserved (Zhou: fig. 5 - Measurement Setup ID Present subfield and a reserved subfield (Reserved) with 7 bits in length; and the Measurement Setup ID field may be 1 byte). 17. The method of claim 15, wherein based on the specific subfield value being set to 0, an ID of at least one specific sensing measurement setup to be terminated among the at least one sensing measurement setup is indicated by the measurement setup ID field (Zhou: fig. 4-5, 12A-12B - each measurement setup ID subfield carries an ID of one sensing measurement setup to be terminated). 18. The method of claim 14, wherein a size of the measurement setup ID field is 1 octet (Zhou: fig. 4-5 - Measurement Setup ID subfield may be 8 bits). 19. The method of claim 14, wherein the first STA does not participate in a sensing measurement instance associated with a sensing measurement setup ID that has been terminated of the at least one sensing measurement setup (Zhou: fig. 6D - if STA 1 does not participate in a sensing measurement, STA 1 can request the AP as a proxy of STA 1 to perform the sensing measurement with another STA). 20. The method of claim 14, wherein the at least one sensing measurement setup response frame includes a status code field indicating a response result to the at least one sensing measurement setup request frame (Zhou: fig. 11 - the sensing measurement setup termination request frame may include a reason code field (Reason Code) for indicating the reason for requesting to terminate the measurement setup, and the reason code may be 1 byte in length). 21. The method of claim 14, wherein: the first STA is a sensing responder, and the second STA is a sensing initiator (Zhou: fig. 6A-6D, fig. 10). Regarding claims 22-23, the independent claim and each dependent claim are related to the same limitation set for hereinabove in claims 14-21, where the difference used is a “apparatus” with a processor and a memory (Zhou: Referring to FIG. 23-24, the device 2300 or 2400 includes a processor 710, a memory 720) and the wordings of the claims were interchanged within the claim itself or some of the claims were presented as a combination of two or more previously presented limitations. This change does not affect the limitation of the above treated claims. Adding these phrases to the claims arid interchanging the wording did not introduce new limitations to these claims. Therefore, these claims were rejected for similar reasons as stated above. Remark: The examiner stresses that the claims are too broad and require detail or specialization of the steps as recited in the claims. Alone and as claimed, the limitations are too open. Examiner has cited particular portions of the references as applied to each claim limitation for the convenience of the applicant. Although the specified citations are representative of the teachings of the art and are applied to the specific limitations within the individual claim, other passages and figures may apply as well. It is respectfully requested from the applicant in preparing responses, to fully consider the references in entirety as potentially teaching all or part of the claimed invention, as well as the context of the passage as taught by the prior art or disclosed by the Examiner. In addition, an interview could expedite the prosecution. Conclusion Any inquiry concerning this communication or earlier communications from the examiner should be directed to Sulaiman Nooristany whose telephone number is (571) 270-1929.
