Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
The instant first office action is in response to communication filed on 09/05/2024.
The IDS(s) submitted 12/05/2024 and 12/26/2025 is being considered.
Claims 1-13 and 15-21 are pending of which claims 1, 11 , 12 and 16 are independent.
Internet Communications
Applicant is encouraged to submit a written authorization for Internet communications (PTO/SB/439, http://www.uspto.gov/sites/default/files/documents/sb0439.pdf) in the instant patent application to authorize the examiner to communicate with the applicant via email. The authorization will allow the examiner to better practice compact prosecution. The written authorization can be submitted via one of the following methods only: (1) Central Fax which can be found in the Conclusion section of this Office action; (2) regular postal mail; (3) EFS WEB; or (4) the service window on the Alexandria campus. EFS web is the recommended way to submit the form since this allows the form to be entered into the file wrapper within the same day (system dependent). Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1,11, 12, and 16 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Nishio et al (US 20250015936 A1).
Regarding claim 1, Nishio discloses a user equipment (UE) (Fig.6 Terminal 200) for wireless communication comprising at least one memory and at least one processor coupled with the at lest one memory and configured to cause the UE (See paragraph 302 on processor and memory in relation to Fig. 5) to:
receive, a control signal (Fig. 6 Control Info S102 sent to the Terminal 200 by base station 100) scheduling one or multiple transport block(s) blocks (See paragraphs 92-93 scheduling SPS ), where each of the one or multiple transport block(s) blocks is associated with a hybrid automatic repeat request (HARQ) process with HARQ feedback enabling or an HARQ process with HARQ feedback disabling
based on at least one of a modulation and coding scheme (MCS) field, a repetition
number field, a HARQ-ACK resource field, or a HARQ enabling or
disabling activation field in the control signal (Per paragraphs 93 and 97 there is a HARQ enabling or disabling info field in the control signal S102) ; and
receive, the one or multiple transport block(s) blocks based on the control signal.(See Terminal 200 in Fig. 6 receiving downlink data S104 based on the control signal S102 – see paragraph 95)
Regarding claim 11, Nishio discloses a method performed by a user equipment (UE) the method comprising:
receiving, a control signal (Fig. 6 Control Info S102 sent to the Terminal 200 by base station 100) scheduling one or multiple transport block(s) blocks (See paragraphs 92-93 scheduling SPS ), where each of the one or multiple transport block(s) blocks is associated with a hybrid automatic repeat request (HARQ) process with HARQ feedback enabling or an HARQ process with HARQ feedback disabling
based on at least one of a modulation and coding scheme (MCS) field, a repetition
number field, a HARQ-ACK resource field, or a HARQ enabling or disabling activation field in the control signal (Per paragraphs 93 and 97 there is a HARQ enabling or disabling info field in the control signal S102) ; and
receiving, the one or multiple transport block(s) blocks based on the control signal.(See Terminal 200 in Fig. 6 receiving downlink data S104 based on the control signal S102 – see paragraph 95)
Regarding claim 16, Nishio discloses a processor (Fig. 5 processor 204 ) for wireless communication, comprising: at least one controller coupled with at least one memory and configured to cause the processor(See paragraph 302 on processor and memory in relation to Fig. 5) to: receive, a control signal (Fig. 6 Control Info S102 sent to the Terminal 200 by base station 100) scheduling one or multiple transport block(s) blocks (See paragraphs 92-93 scheduling SPS ), where each of the one or multiple transport block(s) blocks is associated with a hybrid automatic repeat request (HARQ) process with HARQ feedback enabling or an HARQ process with HARQ feedback disabling based on at least one of a modulation and coding scheme (MCS) field, a repetition number field, a HARQ-ACK resource field, or a HARQ enabling or
disabling activation field in the control signal (Per paragraphs 93 and 97 there is a HARQ enabling or disabling info field in the control signal S102) ; and
receive, the one or multiple transport block(s) blocks based on the control signal.(See Terminal 200 in Fig. 6 receiving downlink data S104 based on the control signal S102 – see paragraph 95)
Regarding claim 12, a base unit (i.e. Fig. 6 Base Station 200 and has to have at least one memory and processor) for wireless communication, comprising at least one memory and at least one processor coupled with the at least one memory and configured to cause the base unit to:
transmit, a control signal (Fig. 6 Control Info S102 sent to the Terminal 200 by base station 100) scheduling one or multiple transport block(s) blocks (See paragraphs 92-93 scheduling SPS ), where each of the one or multiple transport block(s) blocks is associated with a hybrid automatic repeat request (HARQ) process with HARQ feedback enabling or an HARQ process with HARQ feedback disabling based on at least one of a modulation and coding scheme (MCS) field, a repetition number field, a HARQ-ACK resource field, or a HARQ enabling or
disabling activation field in the control signal (Per paragraphs 93 and 97 there is a HARQ enabling or disabling info field in the control signal S102) ; and
transmit, the one or multiple transport block(s) blocks based on the control signal.(See Terminal 200 in Fig. 6 receiving downlink data S104 based on the control signal S102 from base station 200 – see paragraph 95)
Allowable Subject Matter
Claims 2-10, 13, 15, 17-21 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
