Claims 7-12 are currently pending. Claims 7-12 are newly presented via preliminary amendment. And claims 1-7 are canceled via preliminary amendment.
The present application is a 371 national stage entry of Internation Application no. PCT/JP2022/010831, flied on March 11th, 2022.
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Objections
Claims 7-12 objected to because of the following informalities: the claims recite a “CDM group” without defining the acronym CDM. Appropriate correction is required.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 7-12 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Lin et al (U.S. Patent Application Publication no. 2024/0365312, hereinafter Lin).
With respect to claims 7 and 10-12, Lin discloses a terminal, base station, system, and method (paragraph [0003]) comprising:
a receiver that receives an antenna port indication (Table 9, Antenna port field value) when a type of a demodulation reference signal (DMRS) to be configured is not a first type or when a maximum length of the DMRS is not 1 (Table 9, DMRS type = 2 and maxLength =2); and
a processor that controls, based on the antenna port indication, uplink (UL) transmission corresponding to two codewords and using more than four layers (Table 9, both codewords are enabled and total number of layers is greater than 4),
wherein when the type of the DMRS is the first type and the maximum length of the DMRS is 2 (Table 7), the processor controls the UL transmission such that a sum of a number of DMRS port indices corresponding to a first DMRS CDM group and a number of DMRS port indices corresponding to a second DMRS CDM group equals a number of ranks (paragraph [0263]; Table 7, DMRS CDM group).
With respect to claim 8, Lin discloses the terminal according to claim 7, wherein when the type of the DMRS is a second type and the maximum length of the DMRS is 1 (Table 8), the processor controls the UL transmission such that a sum of the number of DMRS port indices corresponding to the first DMRS CDM group, the number of DMRS port indices corresponding to the second DMRS CDM group, and a number of DMRS port indices corresponding to a third DMRS CDM group equals a number of ranks (paragraph [0263]; Table 8, DMRS CDM group).
With respect to claim 9, Lin discloses the terminal according to claim 7, wherein when the type of the DMRS is a second type and the maximum length of the DMRS is 2 (paragraph [0263]; Table 9, DMRS CDM group), the processor controls the UL transmission such that a sum of the number of DMRS port indices corresponding to the first DMRS CDM group, the number of DMRS port indices corresponding to the second DMRS CDM group, and a number of DMRS port indices corresponding to a third DMRS CDM group equals a number of ranks (paragraph [0263]; Table 9, DMRS CDM group).
