Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Information Disclosure Statement Applicant has submitted large amount of Information Disclosure Statements and/or huge number of references and/or reference(s) which are very hefty. Where applicant points the Examiner to large reference or references without citing a specific portion or page, the Examiner will not pour over the documents to extract the relevant information, Ernst Haas Studio, Inc. v. palm Press, Inc. 164 F.3rd 110, 112 (2d Cir. 1999), Winer International Royalty Corp. v. Wang, 202 F3d 1340, 1351 (Fed. Cir. 2000). It is not true, if applicant presents an overload of irrelevant or non-probative references, somehow the irrelevancies will add up to relevant evidence, DeSilva v. DiLeonardi, 181 F.3d 865, 867. Information Disclosure Statements must make all relevant information accessible to the Examiner, rather ask him to play archaeologist with the references, Shiokawa v. Maienfisch, 56 USPQ2d 1406, 1413 and LeVeen v. Edwards 57 USPQ2d 1406, 1413. It is desirable to avoid the submission of long lists of documents if it can be avoided. Eliminate clearly irrelevant and marginally pertinent cumulative information. If a long list is submitted, highlight those documents which have been specifically brought to applicant’s attention and/or are known to be of most significance. See Penn Yan Boats, Inc. v. Sea Lark Boats, Inc., 359 F. Supp. 948, 175 USPQ 260 (S.D. Fla. 1972), aff’d, 479 F.2d 1338, 178 USPQ 577 (5th Cir. 1973), cert. denied, 414 U.S. 874 (1974). But cf. Molins PLC v. Textron Inc., 48 F.3d 1172, 33 USPQ2d 1823 (Fed. Cir. 1995). With this in mind, the Information Disclosure Statement has been considered. Drawings The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the steps or functions of determining whether the transmission condition is fulfilled, upon the transmission condition being fulfilled, transmitting a sidelink positioning reference signal according to the resource scheduling; transmitting the configuration message for sidelink positioning reference signal transmission based on the determined resource scheduling, wherein the configuration message comprises one or more of the determined resource scheduling and the transmission condition for transmitting a sidelink positioning reference signal according to the determined resource scheduling; and transmitting the configuration message, and instructing a radio network node to transmit the configuration message must be shown or the feature(s) canceled from the claim(s). No new matter should be entered. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. The drawings are objected to because the boxes must be also descriptive describe in figures 4-7. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Specification The lengthy specification has not been checked to the extent necessary to determine the presence of all possible minor errors. Applicant’s cooperation is requested in correcting any errors of which applicant may become aware in the specification. Claim Interpretation Under the broadest reasonable interpretation standard, the “or” language, the condition would also not occur and the step or function claimed would never be realized, hence the claim does not require to perform the step or function. See Ex parte Katz, 2011 WL 514314, at 4-5 (BPAI Jan. 27, 2011, 2011 WL 1211248 at 2 (BPAI Mar. 25, 2011); see also In re Johnston, 435 f.3d 1381, 1384 (Fed. Cir. 2006)( "optional elements do not narrow the claim because they can always be omitted”). “Or” conditions are not limitations against which prior art must be found. Under the broadest scenario, the steps or functions dependent on the “or” condition would not be invoked, and such, the Examiner is not required to find these limitations in the prior art in order to render the claim anticipated. In re Am. Acad. Of Sci. Tech Ctr., 367 f.3d 1359, 1359 (Fed. Cir. 2004). The subject matter of a properly construed claim is defined by the terms that limit the scope of the claim when given their broadest reasonable interpretation. It is this subject matter that must be examined. As a general matter, grammar and the plain meaning of terms as understood by one having ordinary skill in the art used in a claim will dictate whether, and to what extent, the language limits the claim scope. See MPEP § 2111.01 for more information on the plain meaning of claim language. Language that suggests or makes a feature or step optional but does not require that feature or step does not limit the scope of a claim under the broadest reasonable claim interpretation. The following types of claim language may raise a question as to its limiting effect: (A) statements of intended use or field of use, including statements of purpose or intended use in the preamble, (B) "adapted to" or "adapted for" clauses, (C) "wherein" or "whereby" clauses, (D) contingent limitations, (E) printed matter, or (F) terms with associated functional language. This list of examples is not intended to be exhaustive. The determination of whether particular language is a limitation in a claim depends on the specific facts of the case. See, e.g., Griffin v. Bertina, 285 F.3d 1029, 1034, 62 USPQ2d 1431 (Fed. Cir. 2002). “Where the printed matter is not functionally related to the substrate, the printed matter will not distinguish the invention from the prior art in terms of patentability.” In re Gulack, 703 F.2d 1381, 1385 (Fed. Cir. 1983) (footnote omitted). Claim limitations directed to the content of information are not entitled to patentable weight unless that information has a "functional relationship" to its substrate. As a general proposition, the Examiner need not give patentable weight to non-functional descriptive material absent a new and nonobvious functional relationship between the descriptive material and the substrate. See In re Ngai, 367 F.3d 1336, 1339 (Fed. Cir. 2004); see also King Pharm., Inc. v. Eon Labs, Inc., 616 F.3d 1267, 1279 (Fed. Cir. 2010); and Manual of Patent Examining Procedure (MPEP) § 2111.05 (9th ed. Rev. 08.2017, Jan. 2018). In Ex parte Nehls, 88 USPQ2d 1883, 1888 (BPAI 2008) (precedential), the Board held that the nature of the information being manipulated by the computer should not be given patentable weight absent evidence that the information is functionally related to the process “by changing the efficiency or accuracy or any other characteristic” of the steps. See also Ex parte Curry, 84 USPQ2d 1272, 1274 (BPAI 2005) (non-precedential) (holding “wellness-related” data stored in a database and communicated over a network was non-functional descriptive material as claimed because the data “does not functionally change” the system). It has been held that to be entitled to weight in method claims, the recited structure limitations therein must affect the method in a manipulative sense, and not to amount to the mere claiming of a use or not the use of a particular structure. Ex parte Pfeiffer, 1962 C.D. 408 (1961). Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 5-9, 11, 12, and 20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The claim language “one or more of” is ambiguous. The use of “or” does not specify whether these alternatives are mutually exclusive or may coexist. As a result, a person of ordinary skill in the art would not be able to determine, with reasonable certainty, the scope of the claimed invention, as required by 35 U.S.C. § 112(b) and as interpreted by Nautilus, Inc. v. Biosig Instruments, Inc., 572 U.S. 898 (2014). This ambiguity is further reflected in dependent claims 5-7 and 20, which rely on the unclear antecedent basis, compounding the indefiniteness. Applicant is advised to amend the claims to clarify the relationship between the alternatives, specify whether both types of addresses can be present, and provide clear antecedent basis to resolve the ambiguity. Claim 9 is confusing for the term “a first transmission condition”. The definition of “first” is coming before all others in time or order, but yet the parent claim has “a transmission condition”. Claims 11 and 12 are confusing because the claims mention “a third transmission condition” and “a fourth transmission condition” and the parent claim only mentions “a transmission condition”, what happen to the second transmission condition for claims 11 and 12, and the third transmission condition for claim 12? Are there on two separate and different transmission conditions or four separate and different transmission conditions? Claim 8 recites the limitation "the transmission conditions". There is insufficient antecedent basis for this limitation in the claim. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 1-17, 19 and 20 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by United States Patent Application Publication 2024/0214966 (Ko, et al). Ko, et al disclose a method performed by a positioning network node (figures 12, 16-20, claims 11-13, #NG,RAN,AMF,LMF,SGC, LOCATRION SERVER, BS) for managing positioning reference signal transmission between a plurality of wireless devices (figure 22). The method comprising obtaining information indicative of contextual information relating to a geographical area being served by the positioning network node (figure 18, #1810, ¶162-164). Initiating a transmission of a configuration message for sidelink positioning reference signal transmission based on the obtained contextual information, wherein the configuration message comprises one or more of a resource scheduling and a transmission condition for transmitting a sidelink positioning reference signal (#1820, ¶162-163, 191). Claim 2, determining, based on the obtained information, the resource scheduling for sidelink positioning reference signal transmission between the plurality of wireless devices (figure 18, #1820, ¶96, 163-164). Claim 3, transmitting the configuration message for sidelink positioning reference signal transmission based on the determined resource scheduling, wherein the configuration message comprises one or more of the determined resource scheduling and the transmission condition for transmitting a sidelink positioning reference signal according to the determined resource scheduling (¶164-165). Regarding claims 4 and 19, this claim describes non-functional descriptive material, note paragraphs 9 and 10 above. Also note ¶189-191 in Ro, et al. Regarding claims 5 and 20, this claim is optional because of the parent “one or more of” phrase, note paragraphs 8 and 13 above. Also note ¶159-161, 191 in Ro, et al. Regarding claim 6, this claim is optional because of the parent “one or more of” phrase, note paragraphs 8, 11 and 13 above. Also note ¶3 and figure 1 in Ro, et al. Regarding claim 7, this claim is optional because of the parent “one or more of” phrase, note paragraphs 8-10 and 13 above. Regarding claims 9-12, as understood, this claim describes non-functional descriptive material and because of the term “are to” , contingent limitations, note paragraphs 9 and 10 above. Regarding claim 13, this claim describes non-functional descriptive material, note paragraphs 9 and 10 above. Regarding claim 14, note ¶165-166. Regarding claim 15, note ¶163-164. Ko, et al shows claim 16, a method performed by a wireless device (claims 1-12, figure 2, #10), for managing side-link communication between a plurality of wireless devices (WDs) (figure 26). The method comprising: receiving, from a network node, a configuration message, the configuration message comprising a resource scheduling for transmitting sidelink positioning reference signals (#1820, ¶162-163, 191) and a transmission condition for transmitting sidelink positioning reference signals according to the resource scheduling, (#1820, ¶162-163, 191) and communicating, based on the received configuration message, a sidelink positioning reference signal in sidelink (¶163-165). Regarding claim 17, determining whether the transmission condition is fulfilled, upon the transmission condition being fulfilled, transmitting a sidelink positioning reference signal according to the resource scheduling (¶186-188). The Examiner has cited particular columns and/or line/paragraphs numbers in the reference(s) applied to the claims above for the convenience of the Applicant. Although the specified citations are representative of the teachings of the art and are applied to specific limitations within the individual claim, other passages and figures may apply as well. IN RE JUNG, No. 10-1019 (Fed. Cir. 2011). Allowable Subject Matter As allowable subject matter has been indicated, applicant's reply must either comply with all formal requirements or specifically traverse each requirement not complied with. See 37 CFR 1.111(b) and MPEP § 707.07(a). Claim 18 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. The following is a statement of reasons for the indication of allowable subject matter: The prior art of record does not disclose or make obvious the now claimed upon the transmission condition not being fulfilled, monitoring sidelink positioning reference signals according to the resource scheduling. In combination with and in a method performed by a wireless device, for managing side-link communication between a plurality of wireless devices (WDs). The method comprising receiving, from a network node, a configuration message, the configuration message comprising a resource scheduling for transmitting sidelink positioning reference signals and a transmission condition for transmitting sidelink positioning reference signals according to the resource scheduling, and communicating, based on the received configuration message, a sidelink positioning reference signal in sidelink. Also, in combination with determining whether the transmission condition is fulfilled, upon the transmission condition being fulfilled, transmitting a sidelink positioning reference signal according to the resource scheduling.
