Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1, 2, 4, 5, 10-13 16-19 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Yang et al. (CN113923614A, now Yang’614).
Yang’614 teaches the determination of the transmission mode based on the large packet service data ratio to either the control plane or user plane in the bottom paragraph of page 8 to the top paragraph of page 9.
With respect to the claims, references to the prior art appear in parenthesis.
Claims
1. (Original) A method for processing a sensing service (Yang CN113923614A, Figure 1) , wherein the method is performed by a first network element (First network element is the access network device 2 in Figure 1) and comprises:
determining a transmission mode for transmitting sensing data, wherein the sensing data is data from at least one source transmitted during execution of the sensing service (Packet service data ratio is used to determine the transmission mode in the bottom paragraph of page 8 to top paragraph of page 9) ; and
the transmission mode is a mode determined from a first mode for transmitting the sensing data based on a control plane (Large packet service data ratio is less than the packet service data ratio corresponds to control plane transmission mode in bottom paragraph of page 8) and a second mode for transmitting the sensing data based on a user plane (Large packet service data ratio is greater than or equal to the packet service data ratio corresponds to user plane transmission mode in top paragraph of page 9) .
2. (Original) The method according to claim 1, wherein determining the transmission mode for transmitting the sensing data comprises: determining the transmission mode for transmitting the sensing data according to predetermined information (Packet service data ratio is used to determine the transmission mode in the bottom paragraph of page 8 to top paragraph of page 9) .
4. (Currently Amended) The method according to claim 2, wherein the predetermined information comprises at least one of: service authorization information of a terminal or a base station; user consent information; information about capability and/or current status of the terminal, the base station, or a core network; information about a sensing service request; or information about a pre-configured processing mode for the sensing data allowed by an operator (Packet service data ratio is a capability Information of the base station in the bottom paragraph of page 8) .
5. (Currently Amended) The method according to claim 4, further comprising: receiving the information about the sensing service request sent by a sensing application server (Terminal 1 needs to report the collected sensing data in the bottom paragraph of page 8, where the AMF server analyzes the collected sensing data in a period of time (i.e. a sensing service request sent to the terminal to report sensing data over a period of time) in the middle of page 13) .
10. (Currently Amended) The method according to claim 1, further comprising: receiving result information of the sensing service (Echo data in the bottom paragraph of page 8) .
11. (Currently Amended) The method according to claim 10, further comprising: sending the result information of the sensing service to a sensing application server (Sensing echo data is sent to the AMF server on page 13 for analysis and processing to determine the sensing result) .
12. (Original) A method for processing a sensing service (Yang CN113923614A, Figure 1) , wherein the method is performed by a third network element (Third network element is the terminal 1 in Figure 1) and comprises:
sending information about a sensing service request to a first network element (First network element is the access network device 2 in Figure 1), wherein the information about the sensing service request is used for the first network element to determine a transmission mode for transmitting sensing data; the sensing data is data from at least one source transmitted during execution of the sensing service (Packet service data ratio is used to determine the transmission mode in the bottom paragraph of page 8 to top paragraph of page 9); and
the transmission mode is a mode determined from a first mode for transmitting the sensing data based on a control plane (Large packet service data ratio is less than the packet service data ratio corresponds to control plane transmission mode in bottom paragraph of page 8) and a second mode for transmitting the sensing data based on a user plane (Large packet service data ratio is greater than or equal to the packet service data ratio corresponds to user plane transmission mode in top paragraph of page 9).
13. (Currently Amended) The method according to claim 12, further comprising: receiving result information of the sensing service (Echo data in the bottom paragraph of page 8) .
16. (Currently Amended) A communication device (Yang CN113923614A, Figure 1), comprising: a memory; and a processor connected to the memory, and configured to:
determine a transmission mode for transmitting sensing data, wherein the sensing data is data from at least one source transmitted during execution of the sensing service (Packet service data ratio is used to determine the transmission mode in the bottom paragraph of page 8 to top paragraph of page 9); and
the transmission mode is a mode determined from a first mode for transmitting the sensing data based on a control plane (Large packet service data ratio is less than the packet service data ratio corresponds to control plane transmission mode in bottom paragraph of page 8) and a second mode for transmitting the sensing data based on a user plane (Large packet service data ratio is greater than or equal to the packet service data ratio corresponds to user plane transmission mode in top paragraph of page 9).
17. (Currently Amended) A non-transitory computer storage medium, having computer executable instructions stored thereon, wherein when executed by a processor, the computer executable instructions cause the processor to perform the method according to claim 1 (Yang CN113923614A, Figure 9) .
18. (New) A non-transitory computer storage medium, having computer executable instructions stored thereon, wherein when executed by a processor, the computer executable instructions cause the processor to perform the method according to claim 12 (Yang CN113923614A, Figure 9).
19. (New) A communication device, comprising: a memory; and a processor connected to the memory, and configured to perform the method according to claim 12 (Yang CN113923614A, Figure 9).
Allowable Subject Matter
Claims 3, 6-9 and 20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter: the prior art of record fails to anticipate or make obvious the additional features of “a candidate mode for executing the sensing service from a predetermined processing mode…comprises at least one of : a first mode for processing the sensing data based on a terminal; a second mode for processing the sensing data based on a base station ; or a third mode for processing the sensing data based on a network..”
