Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-3, 16, 17 and 20 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Vian (US 2018/0148896).
Vian discloses a device 34 for transferring an infrastructure component 20 pre-positioned on a ground surface, in the form of a track support plate, into a target arrangement. The device is comprised of a connecting means 37 for fastening the device 34 to a mating connecting means 37 of the infrastructure component 20. A ground contact means 35 for support on the ground, and an actuating device 38, 39 for absorbing a first rotary movement about a first axis of rotation, characterized by a transmission device 36 for converting the first rotary movement into a first transferring movement of the ground contact means 32 relative to the infrastructure component 20 with a translatory movement component orientated perpendicular to the first axis of rotation.
Allowable Subject Matter
Claims 4-15, 18 and 19 are objected to as being dependent upon a rejected base claim but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
