DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-2 and 7 are rejected under 35 U.S.C. 102(a)(1) and 102(a)(2) as being anticipated by Chu et al (hereinafter “Chu”), US 2021/0235449 A1.
Regarding claims 1 and 7, Chu discloses a wireless LAN communication systems comprising an access point (fig. 1, AP 114), the AP comprises: a transmitter circuitry configured to transmit a data unit after performing carrier sensing (TX/RX units 134s), and a MAC layer processing circuitry unit configured to use an access category related to the data unit during a service period of a Target Wake Time (TWT) recognize a service period configured in TWT (fig. 1 and 6: MAC processor 126 configured to use an access category related to the data unit during a service period of a Target Wake Time (TWT) recognize a service period), wherein the MAC layer processing circuitry decides the access category related to the data unit based on the service period of the TWT (fig. 9, steps 902: At block 902, respective frequency portions of the communication channel are allocated to respective ones of a plurality of second communication devices. For example, the AP 114 allocates respective frequency portions of the communication channel to a plurality of client stations 154, in an embodiment. In an embodiment, the plurality of second communication devices includes a bandwidth-limited second communication device that is capable of operating with a maximum bandwidth that is less than a full bandwidth of the communication channel).
Regarding claim 2, Chu discloses wherein the MAC layer processing circuitry configured to decide one or more parameters for performing carrier sensing corresponding to the access category (p. [0084]-[0085]: In an embodiment, allocating the respective frequency portions at block 902 includes allocating a frequency portion to the bandwidth-limited second communication device, wherein allocation of the frequency portion to the bandwidth-limited second communication device is restricted to the particular component channel in which the second communication device is operating).
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. See attached PTO-892.
