The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Notice of Pre-AIA or AIA Status
In the event the determination of the status of the application as subject to AIA 35 U. S. C. 102 and 103 (or as subject to pre-AIA 35 U. S. C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
Claim Objections
Claim 1 (and similarly claim 13 and 24) is objected to because of the following informalities. Claim states that “in response to a maximum number N of uplink data transmission layers corresponding to a physical uplink shared channel (PUSCH) transmission supported by a single terminal being equal to eight”.
In this limitation, please define what is the maximum possible number “N”. Specification (see Fig. 7; Page 32, lines 5-12) is not clearly defining Maximum number N.
Also please clarify “transmission supported by a single terminal being equal to eight” statement in the claim. Specification (see Fig. 2; Page 9, lines 1-12) is not clearly defining statement.
Appropriate correction is required in all independent claims for further review.
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U. S. C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102 of this title, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. The factual inquiries set forth in Graham v. John Deere Co. , 383 U. S. 1, 148 USPQ 459 (1966), that are applied for establishing a background for determining obviousness under 35 U. S. C. 103 are summarized as follows:
1. Determining the scope and contents of the prior art.
2. Ascertaining the differences between the prior art and the claims at issue.
3. Resolving the level of ordinary skill in the pertinent art.
4. Considering objective evidence present in the application indicating obviousness or nonobviousness.
Claims 1-3, 12-15, 24 and 25 are rejected under 35 U. S. C. 103 as being unpatentable over GaoYukai et al. (US 20200396047 A1) in view of ZHANG et al. (US 20190182777 A1).
Regarding claim 1, GaoYukai teaches a method for indicating a demodulation reference signal (DMRS) port, wherein the method is performed by a network device ([0006], Fig. 1, Fig. 3, e.g. In a first aspect, there is provided a method implemented in a network device. [0047] FIG. 3 shows a flowchart of an example method 300 for DMRS configuration according to some embodiments of the present disclosure. The method 300 can be implemented at the network device 110 as shown in FIG. 1. For the purpose of discussion, the method 300 will be described from the perspective of the network device 110 with reference to FIG. 1. [0124] FIG. 14 shows a flowchart of an example method 1400 in accordance with some embodiments of the present disclosure. The method 1400 can be implemented at a terminal device 120 as shown in FIG. 1. For the purpose of discussion, the method 1400 will be described from the perspective of the terminal device 120 with reference to FIG. 1), and the method comprises:
determining a DMRS port configuration table for a first uplink data transmission layer based on a DMRS type parameter ([0050], e.g. the network device 110 may determine a DMRS configuration table which includes a plurality of possible configurations for DMRS transmission between the network device 110 and different terminal devices. The first configuration can be allocated from the DMRS configuration table for the terminal device 120. For example, an index of the first configuration in the DMRS configuration table can be indicated to the terminal device 120 (such as, in DCI). [0051] In some embodiments, each of the plurality of possible configurations in the DMRS configuration table may indicate at least one of the following: one or more DMRS ports, a scrambling ID of a DMRS sequence, the number of DMRS transmission layers, a DMRS configuration pattern to be used for DMRS transmission, the number of front-loaded DMRS symbols, presence or absence of a CDM group for rate matching, single-user scheduling, multi-user scheduling, single-user and multi-user scheduling, single-panel scheduling, multi-panel scheduling, single-TRP scheduling and multi-TRP scheduling. (i.e. determining a DMRS port configuration table for a uplink data transmission layer based on a DMRS type parameter)),
wherein the DMRS port configuration table comprises a DMRS port allocation set defined for the first uplink data transmission layer ([0052], e.g. As described above, a DMRS port may belong to one CDM group and occupy several REs within one RB. For example, as agreed in 3GPP specification works, there are two types (configuration patterns) of DMRS. For DMRS type 1, one or two symbols can be supported. As shown in FIG. 4A, for DMRS type 1 associated with one symbol, up to 4 DMRS ports (represented as DMRS ports A-D) can be supported. As shown in FIG. 4B, for DMRS type 1 associated with two symbols, up to 8 DMRS ports (represented as DMRS ports A-H) can be supported (i.e. the DMRS port configuration table comprises a DMRS port allocation set). [0053] In some embodiments, in the DMRS configuration table, there may be several configurations associated with a same number of DMRS transmission layers. However, these configurations may be associated with different assumptions, respectively (i.e. a DMRS port allocation set defined for a uplink data transmission layer)); and
indicating, based on the DMRS port configuration table, one or more DMRS ports allocated for the PUSCH transmission to the terminal ([0066], e.g. the DMRS configuration may indicate to the terminal device 120 a first subset of DMRS ports from the CDM group(s) for PDSCH and/or PUSCH transmission. For other DMRS ports (for example the second subset of DMRS ports) within the same CDM group(s), the terminal device 120 may assume them to be present for rate matching. In this event, for example, the power offset of DMRS with respect to PDSCH and/or PUSCH for the terminal device 120 may be assumed to be P.sub.1. (i.e. indicating, one or more DMRS ports allocated for the PUSCH transmission to the terminal)).
GaoYukai teaches a method for Demodulation Reference Signal (DMRS) configuration. However, GaoYukai differs from the claimed invention in not specifically and clearly describing wherein
in response to a maximum number N of uplink data transmission layers corresponding to a physical uplink shared channel (PUSCH) transmission supported by a single terminal being equal to eight.
However, in the analogous field of endeavor, ZHANG teaches wherein
in response to a maximum number N of uplink data transmission layers corresponding to a physical uplink shared channel (PUSCH) transmission supported by a single terminal being equal to eight ([0026, 0052-0054], Fig. 4A, Fig. 4B, Fig. 4C, e.g. determine a relative power ratio of a phase tracking reference signal (PTRS) to a data channel ... the first variable includes a quantity of transport layers or a quantity of DMRS ports, and the second variable includes a frequency domain density of the DMRS; and determine transmit power of the PTRS based on the relative power ratio of the PTRS to the data channel and transmit power of the data channel or based on the relative power ratio of the PTRS to the DMRS and transmit power of the DMRS. [0077] e.g. It can be learned, through calculation according to the formula (4) or (5), that when the quantity of transport layers is 1 to 8, the quantity of DMRS ports is 1 to 8, and the quantity of PTRS ports is equal to or less than the quantity of DMRS ports, the relative power ratio of the PTRS to the PUSCH is shown in Table (1). [0080] The terminal device may further search a table (for example, Table (1) or Table (2)) to obtain the relative power ratio of the PTRS to the PUSCH, finally obtain the power of the PTRS based on the power of the PUSCH, and send the PTRS by using the power of the PTRS (i.e. a physical uplink shared channel (PUSCH) transmission supported by a single terminal being equal to eight layers)).
Therefore, it would have been obvious to one of ordinary skill in the art before the effective filing date of the invention to implement the method of ZHANG within the method of GaoYukai. The motivation to combine references is that the combined method provides a transmit power determining process and a communications device. Embodiments of this application provide a transmit power determining method, so as to flexibly adapt to different quantities of demodulation reference signal (DMRS) ports, different quantities of PTRS ports, or different port multiplexing manner configurations, thereby ensuring efficient energy use, and improving PTRS measurement accuracy (See ZHANG [0002-0003, 0009]).
Regarding claim 2, GaoYukai in view of ZHANG teaches all the limitations of claim 1. GaoYukai further teaches wherein determining the DMRS port configuration table for the first uplink data transmission layer based on the DMRS type parameter comprises:
for each first uplink data transmission layer, generating first DMRS port configuration tables respectively corresponding to different DMRS type parameters ([0099], e.g. In some embodiments, the network device 110 may further indicate to the terminal device 120 a new DMRS configuration table (such as, via RRC signaling) which is generated by restricting some configurations in the complete DMRS configuration table. [0100] there may be some restrictions on a configuration associated with more than one DMRS transmission layer (i.e. generating first DMRS port configuration tables respectively corresponding to different DMRS type parameters)).
Regarding claim 3, GaoYukai in view of ZHANG teaches all the limitations of claim 1. GaoYukai further teaches wherein determining the DMRS port configuration table for the first uplink data transmission layer based on the DMRS type parameter comprises:
for each DMRS type parameter, generating a second DMRS port configuration table corresponding to the DMRS type parameter, wherein the second DMRS port configuration table comprises a first DMRS port configuration sub-table of each first uplink data transmission layer ([0099], e.g. In some embodiments, the network device 110 may further indicate to the terminal device 120 a new DMRS configuration table (such as, via RRC signaling) which is generated by restricting some configurations in the complete DMRS configuration table (i.e. corresponding to different DMRS type parameters). … In another embodiment, the new DMRS configuration table may include several subsets of the complete DMRS configuration table. For example, if one subset is indicated to one terminal device, all of the configurations in the subset may be available for the terminal device. For example, the indication of the new DMRS configuration table including several subsets can be a bitmap. [0100] there may be some restrictions on a configuration associated with more than one DMRS transmission layer (i.e. the second DMRS port configuration table comprises a first DMRS port configuration sub-table of uplink data transmission layer)).
Regarding claim 12, GaoYukai teaches all the limitations of claim 1. GaoYukai further teaches wherein the DMRS port configuration table comprises at least one of a maximum number of symbols of a front-load DMRS corresponding to the DMRS type parameter or a DMRS mapping type ([0048] , e.g. In act 310, the network device 110 determines a first configuration for DMRS transmission. In some embodiments, the first configuration may include first information related to the DMRS transmission. [0049] In some embodiments, for example, the first information may indicate at least one of the following: one or more DMRS ports, a scrambling identity (ID) of a DMRS sequence, the number of DMRS transmission layers, a DMRS configuration pattern to be used for the DMRS transmission, and the maximum number of front-loaded DMRS symbols (i.e. the DMRS port configuration table comprises a maximum number of symbols)).
Regarding claim 13, GaoYukai teaches a method for indicating a demodulation reference signal (DMRS) port, wherein the method is performed by a terminal ([0124] FIG.
However, these configurations may be associated with different assumptions, respectively (i.e. a DMRS port allocation set defined for a uplink data transmission layer)); and
receiving indication information sent by a network device, and acquiring, based on the indication information, one or more DMRS ports allocated for the PUSCH transmission of the terminal from the DMRS port configuration table ([0066], e.g. the DMRS configuration may indicate to the terminal device 120 a first subset of DMRS ports from the CDM group(s) for PDSCH and/or PUSCH transmission.
However, GaoYukai differs from the claimed invention in not specifically and clearly describing wherein
in response to a maximum number N of uplink data transmission layers corresponding to a physical uplink shared channel (PUSCH) transmission supported by the terminal being equal to eight.
However, in the analogous field of endeavor, ZHANG teaches wherein
in response to a maximum number N of uplink data transmission layers corresponding to a physical uplink shared channel (PUSCH) transmission supported by the terminal being equal to eight ([0026, 0052-0054], Fig. 4A, Fig. 4B, Fig. 4C, e.g. determine a relative power ratio of a phase tracking reference signal (PTRS) to a data channel ... the first variable includes a quantity of transport layers or a quantity of DMRS ports, and the second variable includes a frequency domain density of the DMRS; and determine transmit power of the PTRS based on the relative power ratio of the PTRS to the data channel and transmit power of the data channel or based on the relative power ratio of the PTRS to the DMRS and transmit power of the DMRS.
Regarding claim 14, GaoYukai in view of ZHANG teaches all the limitations of claim 13. GaoYukai further teaches wherein determining the DMRS port configuration table for the first uplink data transmission layer based on the DMRS type parameter comprises:
for each layer of the first uplink data transmission layer, generating first DMRS port configuration tables respectively corresponding to different DMRS type parameters ([0099], e.g.
Regarding claim 15, GaoYukai in view of ZHANG teaches all the limitations of claim 13.
Regarding claim 24, GaoYukai teaches a network device ([0006], Fig. 1, Fig. 3, e.g. In a first aspect, there is provided a method implemented in a network device. [0047] FIG. 3 shows a flowchart of an example method 300 for DMRS configuration according to some embodiments of the present disclosure. The method 300 can be implemented at the network device 110 as shown in FIG. 1. comprising a processor and a memory, the memory having stored therein a computer program, the processor executing the computer program stored in the memory ([0008] In a third aspect, there is provided a network device. The network device comprises a processor and a memory coupled to the processor. The memory stores instructions that when executed by the processor, cause the network device to performs actions), to cause the network device to perform:

GaoYukai teaches a method for Demodulation Reference Signal (DMRS) configuration. However, GaoYukai differs from the claimed invention in not specifically and clearly describing wherein
