Claim Rejections - 35 USC § 103
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 1-19 are rejected under 35 U.S.C. 103 as being unpatentable over Mun (KR 101603870) in view of Nakashima et al (EP 2,423,285).
Mun discloses a polyvinyl butyral release agent and a method for delaminating a polyvinyl butyral pressure-sensitive adhesive film. Polyvinyl butyral adhesive film is used to adhere glass sheets during the manufacture of laminated glass for motor vehicles. The glass and the resin of the adhesive film are separated and reused. (cf. paragraphs [0002], [0003], [0006], [0007] and [0011]-[0015]; claims).
However, Mun does not disclose the expansion means as claimed by the applicant. Regarding this difference, the applicant is directed to the reference of Nakashima.
Nakashima discloses a pressure-sensitive, acrylic, thermo-expansive and reusable adhesive tape or sheet. The sheet exhibits favorable adhesive properties when bonded, while being readily heat-separable when separated for reworking or recycling (cf. paragraphs [0001]-[0007], [0011]-[0020], [0023], [0024], [0028], [0029], [0147] and [0214]; claim; examples).
It would have been obvious to one having ordinary skill in the art to employ thermos-expansive adhesive tapes or sheets that can be easily separated by heat, as taught by Nakashima, as the adhesive film in Mun in order to provide the predictable result of imparting desirable separation properties for the laminated glass.
It is the examiner’s position that the specific microcapsules and chemical blowing agents are well known and conventional in the art and would have been obvious to employ in Mun in view of Nakashima in order to provide the predictable result of imparting desirable physical properties to the laminated glass being manufactured.
