Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-14 and 16-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention.
The recitation of “receive a configuration … device”, recited in claim 1, lines 8-9 is vague because it is unclear of receiving the “configuration” from whom? Moreover, the recitation of “ adapt the SL PRS … measurement” recited at lines 12-13 is confusing since it is unclear of the purpose of adapting the SL PRS transmit power?
Similar problems exist for the same recitations recited in claim 14, lines 3-4 and lines 7-8; and claim 16, lines 4-5 and 9-10.
Dependent claims 2-13 and 17-20 are also rejected because of its dependency (directly or indirectly) from respective claims 1 and 16.
Allowable Subject Matter
Claim 15 is allowed over prior art of record.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. References Abedini et al (US 2018/0115363), Baek (US 2022/0201617), Ko et al (US 2022/0385423), Choi et al (US 2023/0115517) and Hwang et al (US 2023/0145928) are cited because they are pertinent to the method and apparatus for sidelink power controlling. However, none of the cited references teaches or suggests the arrangements of an apparatus for wireless communication, comprising: at least one memory; and at least one processor coupled with the at least one memory and configured to cause the apparatus to: receive a configuration for adapting a transmit power of a sidelink ("SL") positioning reference signal ("PRS") transmission for a responder device; receive a reported received signal strength ("RSS") measurement from the responder device; and adapt the SL PRS transmit power for the responder device based on the received configuration and the RSS measurement as recited in claim 1 and similar limitations as recited in claims 14-16 and further limitations of the dependent claims 2-13 and 17-20.
