Office Action

§112
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . DETAILED ACTION This Office action is responsive to communications filed on June 30, 2026. Claims 1-3 and 5-38 are currently pending in the application. Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after allowance or after an Office action under Ex Parte Quayle, 25 USPQ 74, 453 OG 213 (Comm’r Pat. 1935). Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, prosecution in this application has been reopened pursuant to 37 CFR 1.114. Applicant’s submission filed on 6/30/2026 has been entered. Claim Objections Claims 15-38 are objected to because of the following informalities: Claim 15 is objected to because the phrase “the method using a device” at lines 2-3 is unclear. It is not clear whether the method is performed by the device, performed using the device, or intended to refer to the device of claim 1. Appropriate correction is required for clarity. Claims 16-38 are objected to because they depend from objected-to claim 15. Additionally: Claims 24 and 25 are objected to because the recitation of “a device” is unclear as to whether it refers to the device previously introduced in claim 15 or to a different device. Appropriate correction is required. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-3 and 5-14 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention. Claim 1 is rejected under 35 U.S.C. 112(b) because the scope of the limitation “remote system” is unclear. It is not reasonably certain whether the “remote system” refers to the RFID reader/exciter, the RFID tag, a cloud server, or another device described in the specification. Consequently, the metes and bounds of the claim are not reasonably certain. Claims 2-3 and 5-14 are rejected under 35 U.S.C. 112(b) as being indefinite by virtue of their dependency on claim 1. Appropriate correction or clarification is requested. Allowable Subject Matter Claims 1-3 and 5-38 would be allowable if rewritten to overcome the objection(s) and rejection(s) under 35 U.S.C. 112(b) set forth in this Office action. The following is a statement of reasons for the indication of allowable subject matter over the prior art: None of the references cited in the 6/30/2026 IDS, nor the updated search, yielded prior art sufficient to teach or suggest all of the limitations of independent claims 1 and 15. Accordingly, pending claims 1-3 and 5-38 are considered to define over the prior art of record. Conclusion Any inquiry concerning this communication or earlier communications from the examiner should be directed to ADNAN AZIZ whose telephone number is (571) 270-7536, (Fax: 571-270-8536).
