Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-2, 12-13 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1, line 17-18 recited the limitation “wherein the plurality of predicted CSI is generated using the plurality of CSI.” It is not clear what “the plurality of CSI” in the claim referred to. Is “the plurality of CSI” referred to the “measuring a plurality of CSI based on the plurality of CSI-RS” recited in line 11.
Claim 2 recited “wherein the second plurality of predicted CSI is generated using the second plurality of CSI.” It is not clear what “the second plurality of CSI” referred to. Is it referred to the “measuring a second plurality of CSI based on the second plurality of CSI-RS”.
Claim 12 recited “wherein the predicted CSI are generated using the plurality of CSI.” It is not clear what “the plurality of CSI” referred to. Is it the “measure a plurality of CSI based on the plurality of CSI-RS”.
Claim 13 recited the limitation “wherein the second plurality of predicted CSI is generated using the second plurality of CSI.” It is not clear what “the second plurality of CSI” referred to. Is it referred to the “measure a second plurality of CSI based on the second plurality of CSI-RS”.
Allowable Subject Matter
Claims 1 and 12 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
Claims 2 and 13 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter:
The closest prior art made of record: BAI et al. US 2021/0091838 A1) discloses a method implemented by a wireless transmit/receive unit (Fig. 4, 5),the method (System and Method for Determining Channel State Information) comprising:
receiving, from a network node, configuration information indicating:
a first period of time to receive and measure channel state information by the WTRU (par. 82), wherein the size of the second period of time is smaller or equal to a maximum size of the second period of time (implicit), and wherein the second period of time is after the first period of time (par. 78);
receiving, during the first period of time from the network node, a plurality of CSI reference signal (Fig. 4; 428a...c);
measuring a plurality of CSI based on the plurality of CSI-RS (par. 72, Fig. 4: 432).
BAI et al. further teaches determine at least one parameter associated with the predictive model and evaluate predictive model for predicting CSI based on the CSI.
BAI et al. fails to teach or fairly suggests in combination “determining an updated size of the second period of time, wherein the updated size of the second period of time is based on a measurement performed on at least one CSI-RS of the plurality of CSI-RS received, and wherein the updated size of the second period of time is smaller or equal to the maximum size of the second period of time; and
transmitting, to the network node, the updated size of the second period of time and a plurality of predicted CSI for the first period of time, wherein the plurality of predicted CSI is generated using the plurality of CSI.
Another prior art made of record: Li et al. (US 2006/0165008 A1) discloses one or more nodes of system may be arranged to perform channel prediction. More particularly, base station 110 and/or subscriber stations 120, 150 may be arranged to predict channel state information for a communication channel. By predicting channel state information, the impact of feedback delay between measured channel state information and current channel state information may be reduced.
