Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 20 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 20 recites the limitation "the apparatus" in the preamble. There is insufficient antecedent basis for this limitation in the claim.
Allowable Subject Matter
Claims 1-19 are allowable
Claim 20 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter: The prior art before the effective filing date of the claimed invention teaches default values for power control, and these are implicit the system must be initialized to a value in order to function. The 3GPP sections, as cited by applicant and the international search report show that in accordance with the standard there are existing practices for the use of default power control values. See 3GPP R1-2106542 which talks about default values on more than one field for power control and boosting in relation to the TRP.
The prior art does not teach or fairly suggest, as a whole, the absence/presence of values related to both a first and a second TCI related to the TRP commensurate with the claimed language, including selecting at least one of a first set of power control parameters associated with a first transmission and reception point (TRP) or a second set of power control parameters associated with a second TRP in accordance with a default power control parameter scheme, wherein the default power control parameter scheme is associated with an absence of signaled power control parameters for a first transmission configuration indicator (TCI) state associated with the first TRP or a second TCI state associated with the second TRP; and trigger at least one of a first transmission to the first TRP in accordance with the first set of power control parameters or a second transmission to the second TRP in accordance with the second set of power control parameters.
When incorporating each and every limitation of the respective claims as a whole and in combination, none of the prior art discloses the features as claimed.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
See the attached PTO-892 for further state of art references related to transmit power control.
