DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
Applicant’s election without traverse of the species wherein formula I is according to formula (la) and R¹ is according to formula (IV) in the reply filed on July 29, 2026 is acknowledged.
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claims 1, 2, 9, and 10 are rejected under 35 U.S.C. 103 as being unpatentable over Wilson et al, US 5,733,858.
Wilson et al teach a liquid laundry detergent comprising a polyamino disuccinic acid (col. 3, lines 1-10) wherein the polyamino disuccinic acid may be 1,6-hexamethylenediamine-N,N-disuccinic acid (corresponds to the compound of formula (I) wherein A1 is - (CH2)6-, R1 is of formula (IV) wherein R2 is HO-* meaning formula (V) wherein c=0 and R3=H) (col. 4, line 29) and so it would have been obvious for one of ordinary skill in the art to formulate a liquid laundry detergent comprising hexamethylenediamine-N,N-disuccinic acid with confidence of forming an effective liquid detergent as this is taught as a suitable component of the invention.
Claims 1, 2, and 6-8 are rejected under 35 U.S.C. 103 as being unpatentable over Koehler et al, CA 2,511,935.
Koehler et al teach a coating composition comprising a polyaspartic acid ester according to formula I where X is an alkyl radical of 6, n is 2, A and A’ are methyl, and l and m add to at least 2 (page 3, formula I), which corresponds to the compound of formula (I) wherein A1 is - (CH2)6-, R1 is of formula (IV) wherein R2 is ethoxy, meaning formula (V) wherein c=1 and R3=H. It would have been obvious for one of ordinary skill in the art to formulate a compound according to formula I of the reference as this compound is contemplated by the reference.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. The examiner notes that hexamethylenediamine-N,N-disuccinic acid is a well-known compound.
