(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 16-29 are rejected under 35 U.S.C. 112, second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which applicant regards as the invention.
In claim 16, the term(s) “in case” is/are not clear if anything can actually be performed. However, the claims will be given a broad reasonable interpretation for the purposes of examination as best understood.
In addition, in order to overcome the 35 USC 112 rejection set forth above in claim 16, applicant is suggested to include recitation of a “wherein when that a ,,,,” into the claim
limitation
Claims 17-29 are rejected for similar reasons as stated for claim 16.
Remark:
In addition, an interview could expedite the prosecution.
