Office Action

§101 §102 §103 §112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Drawings The drawings are objected to because figs 1-7 lack clear description of the elements in each figures. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Objections Claims 1,2 are objected to because of the following informalities: claims 1,2 recites “a transceiver 131” the numbering should be deleted. Appropriate correction is required. Claim Rejections - 35 USC § 101 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. Claims 24,25 are rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter. The claim(s) does/do not fall within at least one of the four categories of patent eligible subject matter because claims 24,25 recite “A computer program product on a computer readable medium,” applicant’s disclosure defines “a computer readable medium” in paragraph [0157] as “ the computer readable medium 1000 may be any suitable computer readable medium, such as a hard disk, solid state memory, flash memory, etc., and may be non-recordable or recordable.” The applicant’s disclosure does not exclude “a computer readable medium” being a transitory medium such as signal. Therefore, claims 24,25 are non-statutory subject matter, since a signal is non-statutory subject matter. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 11-12, 16,20-21 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 11 recites “ A network access device, the network access device comprising a transceiver for wireless communication with the wireless communication device according to a wireless communication protocol and comprising at least one relay device according to claim 1” it is not clear as to what the claim sought to cover. Claim 11 seems to be presented as an independent claim of “ A network access device,” however, it is also seems to be dependent on claim 1. It is not clear whether claim 11 incorporates all the language of independent claim 1. Therefore, claim 11 is ambiguous. Claim 12 recites “A Configurator arranged to cooperate with the relay device as defined in claim 1 according to a configuration protocol,” it is not clear as to what the claim sought to cover. Claim 12 seems to be presented as an independent claim of “ A Configurator,” however, it is also seems to be dependent on claim 1. It is not clear whether claim 12 incorporates all the language of independent claim 1. Therefore, claim 12 is ambiguous. Claim 16 recites “A method for use in a relay device of claim 1,” It is not clear whether claim 16 incorporates all the language of independent claim 1. Therefore, claim 16 is ambiguous. Claim 20 recites “A method for use in a Configurator device according to claim 12, the Configurator being arranged to cooperate with a relay device according to claim 1-9” It is not clear whether claim 20 incorporates all the language of claim 12, claims 1-9. Therefore, claim 20 is ambiguous. Claim 21 recites “A method for use in a Configurator device according to claim 12, the Configurator being arranged to cooperate with a relay device according to claims 1-9” It is not clear whether claim 20 incorporates all the language of claim 12, claims 1-9. Therefore, claim 21 is ambiguous. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
