Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
Claims 5-12 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor regards as the invention.
Claim 5 recites the limitation "the second housing side". There is insufficient antecedent basis for this limitation in the claim. For the purposes of examination, "the second housing side" will be interpreted as “the second housing portion”. Dependent claims 6-12 are likewise rejected and interpreted.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1, and 13-16 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Liao (US20050253011) “Liao”.

Claim Rejections - 35 USC § 103
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claims 2-4 are rejected under 35 U.S.C. 103 as being unpatentable over Liao in view of Bridges et al. (US20130133215) “Bridges”.
Regarding claim 2, Liao discloses the tape measure of claim 1.
Liao does not disclose a finger brake opening.
Bridges teaches a finger brake opening (Fig. 1; 30).
It would have been obvious to one of ordinary skill in the art before the effective filing date to form Bridges finger brake opening between Liao’s the first and second housing portions, making it easier for a user to slow or stop blade retraction.
Regarding claim 3, Liao discloses the tape measure of claim 2, wherein the structure of the first housing portion that extends at least substantially the entire width of the mouth (Fig. 2; 13), under the tape blade, forms a common tape mouth structure (Fig. 2; 13).
Liao does not disclose the finger brake opening.
Bridges teaches the finger brake opening (Fig. 1; 30).
It would have been obvious to one of ordinary skill in the art before the effective filing date for Liao’s structure that extends at least substantially an entire width of the mouth to also define a portion of Bridges’ finger brake opening to form a common tape mouth and finger brake structure, allowing one feature to both stop Liao’s hook and form a portion of Bridges’ finger brake opening, making Liao’s tape measure more compact and user friendly.
Regarding claim 4, Liao discloses the tape measure of claim 3, wherein the seam (Fig. 2; line where 101 joins, not labelled) extends away from the mouth (Fig. 2; 13).
Liao does not disclose the finger brake opening.
Bridges teaches the finger brake opening (Fig. 1; 30).
It would have been obvious to one of ordinary skill in the art before the effective filing date for Liao’s seam to be formed behind Bridges’ finger brake opening, extending Liao’s seam and improving tape measure usability.
Claims 5-12 are rejected under 35 U.S.C. 103 as being unpatentable over Liao in view of Burch et al. (US11768066) “Burch”.
Regarding claim 5, Liao discloses the tape measure of claim 1, further comprising a first engagement feature (see labelled excerpt of Fig. 2 below) formed on one of the structure and the second housing side (Fig. 2; 101) the first engagement feature shaped to engage at the seam (Fig. 2; line where 101 joins, not labelled) at the side of the mouth (Fig. 2; 13).
