CTNF 18/863,360 CTNF 86251 Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 112 07-30-02 AIA The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. 07-34-01 Claims 1-15 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. As to claim 1, it is unclear as to how the 1 st and the 2 nd spiral portion could have a fixed end on the frontend surface side of the brush when the opposite end of each of the spiral portions are urging the pressing member, which is engaging the brush at its opposite end, towards the commutator which is also at the front end surface side of the brush. The examiner belies that the claim is referring to the brush holder instead of the brush itself. For examining purposes, the limitation will be construed as taught by the prior art. Claims 2-15 are likewise rejected as they depend from claim 1 directly/indirectly. Appropriate correction is required. Claim Rejections - 35 USC § 102 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-12-aia AIA (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. 07-15-03-aia AIA Claim(s) 1, 5, 7, and 15 is/are rejected under 35 U.S.C. 102 (a)(2) as being anticipated by Wu et al. (CN 2013694484) . 1. Wu teaches: An electric motor/generator (for generator, see paras 0002 and 0004; since the motor limitation is in the preamble and the body of the claim does not differ in structure, the limitation is not being given patentable weight. Thus making the generator disclosed by Wu qualify as meeting the limitation of the motor, MPEP 2111.02) comprising: a rotor (inherent since a rotating shaft is disclosed, MPEP 2112 and machine translation para 0007) including a rotating shaft (machine translation para 0007) extending in an axial direction (inherent since a rotating shaft is disclosed, MPEP 2112 and machine translation para 0007); a commutator (for sliprings see machine translation 0002 and 0008) attached to the rotating shaft (inherent since a rotating shaft is disclosed, MPEP 2112 and machine translation para 0002 and 0007); a brush 1 including a front end surface (annotated fig 1 below) coming into contact with the commutator (annotated fig 1 below) and a rear end surface (annotated fig 1 below) positioned on a side opposite to the front end surface; a constant load spring (4 and 34 make up the spring) having a first spiral portion (on 4) and a second spiral portion (on 34) each made of a strip-shaped wire material wound in a spiral shape (see fig 1 below), and including a fixed end on the front end surface side of the brush (see 112 rejection above and annotated figure below); and a pressing member/wear-resistant arc plate 5 coming into contact with the rear end surface of the brush to press the brush against the commutator with a load (the load being the force from the spiral portions) from the constant load spring. Wu teaches: The electric motor according to Claim 1, wherein each of the first spiral portion and the second spiral portion of the constant load spring comes into contact with the pressing member at one point in a section taken along a plane (the plane being fig 1, see fig above) passing through an axis of the rotating shaft. 7. Wu teaches: The electric motor according to Claim 1, wherein the rear end surface of the brush comes into contact with the pressing member at two points in a section taken along a plane (the plane being fig 1, see fig above) passing through an axis of the rotating shaft. 15. Wu teaches: The electric motor according to Claim 1, wherein the rear end surface of the brush includes an arc shape (the pressing member is referred to as an arc shaped plate) when the brush is viewed from above . Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim s 2-4, 6, and 8-14 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
