The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1, 9, 10, and 14 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Rong et al (US Publication 2018/0176900 A1).
Regarding to claims 1, 10, and 14, Rong discloses a system (fig. 14), comprising: a telecommunications network 310 comprising an access network 304 and a core network 308 (page 16 paragraph 0158); and a terminal device 306 in the telecommunications network (page 16 paragraph 0158); wherein, regarding a specific user equipment functionality (page 10 paragraph 0119), the telecommunications network is configured to: initialize or provide a logical user equipment entity or functionality such that the terminal device, together with the logical user equipment entity or functionality, provides or realizes or is able to provide or realize the specific user equipment functionality (page 16 paragraph 0159); assign logical user equipment identifier information to the terminal device (page 16 paragraph 0159; cloud processor 308 assigns logical entity ID to terminal device 304), and transmit the logical user equipment identifier information is transmitted to the terminal device (page 16 paragraph 0159; cloud processor 308 transmits logical entity ID to terminal device 306 via TP 306).
Regarding to claim 9, Rong discloses the specific user equipment functionality corresponds to a functionality that the terminal device is unable to provide or realize without the logical user equipment entity or functionality (page 14 paragraph 0145; logical entity can be created and removed to provide or realize for user equipment).
Allowable Subject Matter
Claims 2-8 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
