Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1 and 6-10 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by CN-107141441 to He et al. (Cited on IDS, English Translation provided by applicant).
As to claims 1 and 6-10, He discloses a transparent thermoplastic polyurethane comprising the reaction product of 18 parts of isophorone diisocyanate, 21 parts of PTMG with a molecular weight of 2,000, and 15 parts of ethylene glycol chain extender (Example 3) in the presence of stannous octoate additive catalyst.
Claims 1, 3-5, and 8-10 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by CN-113956429 to Wu et al. (Cited on IDS, English Translation provided by applicant).
As to claims 1, 3-5, and 8-10, Wu discloses a thermoplastic polyurethane comprising the reaction product of 60 parts by weight of diisocyanate (4:1 blend of HMDI and IPDI), 74 parts of poly(caprolactone)polyol with a molecular weight of 830 to 2,000, and 1,4-butanediol as a chain extender wherein the thermoplastic polyurethane contains esters and additives (Examples 1 and 3).
Claims 1-2 and 8-10 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by CN-104031238 to Ai et al. (Cited on IDS, English Translation provided by applicant).
As to claims 1-2 and 8-10, Ai discloses thermoplastic polyurethane comprising the reaction product of 4kg of hydroxy-terminated ethylene adipate, 1.726 kg of a 2:1 mixture of MDI and IPDI, and 1,4-butanediol as a chain extender (Example), wherein the reactive mixture further discloses the addition of chitin microparticle additives to achieve high moisture permeability, good mechanical properties and comfort (0025).
