Claim Objections Claims 1-15 are pending in the application. Priority 02-26 AIA Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Claim Rejections - 35 USC § 112 07-34-01 Claims 5-11 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 5 in line 2 refers to “the data code”. There are two references to “a data code” in claim 2, on which claim 5 depends (with claim 4 in the interim). It is ambiguous as to whether “the data code” indicates the type of the data (lines 4-5 in claim 2) or whether “the data code” indicates the details of the data. For purposes of examination it is assumed that “the data code” refers to the type of the data. (If “the data code” is to refer to both types of data code, it is suggested that claims 2 and 5 be rewritten.) Claim 6 in line 2 refers to “the data code”. There are two references to “a data code” in claim 2, on which claim 6 depends (with claim 4 in the interim).
