Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Objections Claim 4 is objected to because of the following informalities: on line 3, insert “is” between “ignoring” and “in.” Appropriate correction is required. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-14 and 16-21 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claims 1 and 14 recited the limitation “ignoring (ignore), at the CU, the non-SDT configuration.” It is unclear as to what exactly this means and how this is carried out in the applicant’s specification. The applicant’s specification consistently discloses ignoring the non-SDT configuration. However, it is unclear as to how the non-SDT is ignored by the CU when it is received by the CU. Exactly what is not performed (or performed) when the CU ignores the non-SDT configuration? The applicant’s specification fails to specify exactly what ignoring a received non-SDT configuration entails. Therefore, the claims are indefinite. Claims 2-13 and 16-21 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite by virtue of being dependent on claims 1 and 14 respectively. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Lei et al US 20250048485 ([0110], [0118]) discloses configuration information including data volume thresholds for MT-SDT/MO-SDT selection or non-SDT selection. Ahluwalia et al US 20250024545 discloses a gnB-CU keeping non-SDT bearers suspended.
