The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1, 4-8, 11 and 12 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Furuyama (US Pub. 2023/0246758).
Regarding claims 1 and 6-8, Furuyama teaches a received signal power prediction system comprising: a received signal power prediction apparatus that predicts received signal power of a communication terminal after a predetermined period has elapsed (see Server Device in Figure 5); and the communication terminal, which can communicate with the received signal power prediction apparatus via a communication network (see In-Vehicle Device in Figure 2), wherein the received signal power prediction apparatus includes a first memory; and a first processor coupled to the first memory (see control unit 203 and storage unit 201 in Figure 5), the communication terminal includes a second memory; and a second processor coupled to the second memory (see control unit 105 and storage unit 109 in Figure 2), the first processor is configured to acquire an actually measured value of received signal power of the communication terminal and a position of the communication terminal (see “communication quality information” in [0054] and “location information” in [0050]); the second processor is configured to predict a predicted position of the communication terminal after the predetermined period has elapsed based on the position of the communication terminal (“planned position information” in [0068]); the first processor is configured to acquire an estimated value of received signal power at the predicted position of the communication terminal (“The radio wave map is a set of states or estimation results of the communication quality at a specific position” in [0034]); and the first processor is configured to predict the received signal power of the communication terminal after the predetermined period has elapsed using the actually measured value of the received signal power and the estimated value of the received signal power (“the radio wave map in addition to the planned position information” in [0070]).
Regarding claims 4 and 11, Furuyama teaches the first processor acquires the estimated value of the received signal power at the predicted position of the communication terminal from a storage that stores in advance received signal power calculated or measured at a plurality of evaluation points (“a memory that stores the radio wave map” in [0103]).
Regarding claims 5 and 12, Furuyama teaches the first processor estimates the estimated value of the received signal power at the predicted position of the communication terminal based on static environment information and a position of a base station (the server device, the radio wave map update device, estimates a blockage situation on the basis of relative positions (“location of the base station”) of vehicles and the base station, and updates the reference communication quality information, see [0108]-[0110]).
Allowable Subject Matter
Claims 2, 3, 9 and 10 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
