DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . This Office Action is responsive to the Applicant's communication filed on December 9, 2024. In view of this communication, claims 1-22 are now pending in the application.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-22 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 recites, “a torsionally stiff winding”, this is unclear because it is not well defined what torsionally stiff means in the context of a winding.
In order to properly conduct a search on the subject, the torsionally stiff winding is interpreted to mean, “a winding”
Claims 2-22 are rejected solely due to their dependency on claim 1.
Claim 1 recites the limitation " the conductor bars" in the first paragraph of claim 1. There is insufficient antecedent basis for this limitation in the claim.
Allowable Subject Matter
Claims 1-22 are allowed.
The following is an examiner' s statement of reasons for allowance:
Regarding claim 1, the following is a statement of reasons for the indication of allowance:
While the prior art pieces do teach all the limitations in part one way or another, it would not have been obvious to combine them in such a way to achieve the present invention. The limitations are taught by the prior art, but would not be obvious to combine because while a helical winding and oblique magnetic field are both taught in the prior art, but not in different directions; there is no previously disclosed reason to combine them. Thus, the claim contains allowable subject matter.
Claim 1 is allowed, and not rejected, because the limitation of a helical winding and oblique magnetic field is too specific which makes it novel.
Claims 2-22 are also allowed because they depend from allowed claims 1.
As allowable subject matter has been indicated, applicant's reply must either comply with all formal requirements or specifically traverse each requirement not complied with. See 37 CFR 1.111(b) and MPEP § 707.07(a).
