Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . DETAILED ACTION Information Disclosure Statement 1. The information disclosure statement (IDS) submitted on 12/18/2024 and 04/22/2026 has been considered by Examiner and made of record in the application file. Claim Rejections - 35 USC § 102 2. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. 3. Claims 1-6 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Shvodian (U.S PAT. 11,503,554). Consider claim 1, Shvodian teaches a terminal comprising: a control section that determines, based on at least one of a specific maximum output power (col. 5, lines 26-43 i.e., FDD max power 20dBm), a resource amount used for one or more first uplink transmissions (col. 5, lines 4-43 i.e., FDD duty cycle), and a first transmit power (col. 5, lines 4-43 i.e., FDD average power) used for the one or more first uplink transmissions, an upper limit of a second transmit power for a second uplink transmission (col. 5, lines 26-43 i.e., TDD max power 23dBm); and a transmitting section that performs the second uplink transmission by using the second transmit power (fig. 2, col. 11, lines 13-19 i.e., TDD air interface). Consider claim 2, Shvodian further teaches wherein the control section determines the upper limit by adding or subtracting an adjustment amount based on the resource amount to or from a value based on the specific maximum output power (col. 6, lines 4-17 i.e., resource amount is the duty cycle). Consider claim 3, Shvodian further teaches wherein the control section determines available energy based on the specific maximum output power in a specific period and determines the upper limit in the specific period based on the available energy (col. 5, lines 44-55). Consider claim 4, Shvodian further teaches wherein the specific maximum output power is 30 dBm or higher or is lower than 23 dBm (col. 5, lines 26-43). Consider claim 5, the subject-matter of independent claim 5 relates to a radio communication method for a terminal with features fully corresponding to the characteristics of claim 1. Therefore, the same argumentation presented in relation to claim 1 is, mutatis mutandis, of application to claim 5. Consider claim 6, the subject-matter of independent claim 6 relates to a control section with features fully corresponding to the characteristics of claim 1. Therefore, the same argumentation presented in relation to claim 1 is, mutatis mutandis, of application to claim 6. Conclusion 4.
