Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1, 10 and 21 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Peng (CN 113111692 A) (Cited in IDS).
Regarding Claim 1, Peng teaches A point cloud object detection method, wherein the method comprises: (¶0004: An embodiment of the present disclosure provides a target detection method) obtaining a three-dimensional_(3D) point cloud frame collected by a radar (¶0042: wherein the target detection device can be all kinds of device for collecting point cloud data, such as laser radar, stereo camera time camera and so on. The point cloud frame can be a set of point cloud data collected at a certain time by a certain target detection device. point cloud data generally comprises three-dimensional coordinate data); performing object detection on the 3D point cloud frame to obtain a 3D object bounding box represented by 3D coordinates of bounding box corner points; (¶0061: For example, the average value of the coordinate component of each corner of the first detection frame corresponding to the reference point respectively the cluster 306 is taken as the coordinate component of the corner detection frame.) and obtaining an object detection result based on the 3D object bounding box.( ¶0061: based on the reference point respectively the cluster 306 corresponding to the first detection frame, determining the second detection frame corresponding to the cluster 308. 61) so as to determine the second detection frame representing the position of the target object 308.)
Claim 10 recites a computer apparatus with the elements of the method recited in Claim 1. Therefore, the recited elements of this claim are mapped in the same manner as the corresponding steps in its corresponding method claim. Finally, Peng discloses a computer device, comprising at least one processor and a storage apparatus configured to store a plurality of program codes, wherein the program codes are adapted to be loaded and executed by the at least one processor to perform the point cloud object detection method, the method comprises…(¶0007: According to another aspect of the present disclosure, there is provided an electronic device, the electronic device comprises: a processor; a memory for storing processor-executable instructions; a processor for reading the executable instruction from the memory, and executing the instruction to realize the target detection method.)
Regarding Claim 21, Peng teaches a vehicle, comprising the computer device. (¶0004: obtaining the point cloud frame collected by each target detection device respectively the plurality of target detection devices on the vehicle…)
Allowable Subject Matter
Claim(s) 2-9 and 13-20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
