DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Specification
The lengthy specification has not been checked to the extent necessary to determine the presence of all possible minor errors. Applicant’s cooperation is requested in correcting any errors of which applicant may become aware in the specification.
Claim Objections
Claims 20-21, 25-26 and 30-31 are objected to because of the following informalities: Claim 20, line 3, after “state”, please insert “in the two TCI states” for consistency with antecedent in claim 19, line 3.
As per claim 25, line 3, see claim 20.
As per claim 30, line 3, see claim 20.
Claims 21, 26 and 31 are objected for being dependent on an objected claim.
Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 17-31 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 17 recites the limitation "the multiple panel simultaneous uplink transmission scheme" in lines 11-12. There is insufficient antecedent basis for this limitation in the claim. It appears that "the multiple panel simultaneous transmission scheme" was intended. Please correct.
Claims 22, last two lines, see rejection of claim 17.
Claims 27, last two lines, see rejection of claim 17.
Any claim whose base claim is rejected is likewise rejected.
Allowable Subject Matter
Claims 17-31 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
The following is a statement of reasons for the indication of allowable subject matter: a method and apparatus are disclosed. The closest prior of record, taken alone or in combination do not teach or fairly suggest the limitations of “receiving, from a network device, an indication of a multiple panel simultaneous transmission scheme, performing a phase tracking reference signal (PTRS) transmission based on transmission power of the PTRS transmission, wherein: the transmission power of the PTRS transmission is determined based on a physical uplink shared channel (PUSCH) to PTRS power ratio, and the PUSCH to PTRS power ratio for an antenna port for PTRS is determined based on a number of PUSCH layers associated with a same reference signal resource set among two reference signal resource sets, as the antenna port for PTRS, and the multiple panel simultaneous uplink transmission scheme”, recited in the base claims.
