DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1, 2 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Xu (CN 208385035).
Re Claim 1, Xu discloses a wiring member for an electrical instrument, comprising:
a plurality of first conductors (2, 6) electrically connected (at ground point 16) and laminated with each other (abstract);
a second conductor (4) provided between the first conductors and not electrically connected with any other conductors; and insulating materials (3, 5) provided between each of the first conductors and the second conductor (Fig 1).
Re claim 2, comprising: two members each including the first conductors, the second conductor, and the insulating materials, wherein the two members are opposed to each other in a laminating direction of the first conductors, and include an insulating material between the members (Fig 1).
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 3, 4 is/are rejected under 35 U.S.C. 103 as being unpatentable over Xu (CN 208385035) in view of Nakayama (JP 2008-245541).
The teaching as discussed above does not disclose wherein the first conductors of one of the members are connected with a positive electrode of a DC power supply, and wherein the first conductors of the other of the members are connected with a negative electrode of a DC power supply (re claim 3), a capacitor; a switching element that switches a DC current on and off; and a wire connecting the capacitor and the switching element, the wire is the wiring member (re claim 4).
Nakayama teaches the first conductors of one of the members are connected with a positive electrode (P) of a DC power supply, and wherein the first conductors of the other of the members are connected with a negative electrode (N) of a DC power supply, a capacitor (7, 45); a switching element (39, 40) that switches a DC current on and off; and a wire connecting the capacitor and the switching element, the wire is the wiring member (Fig 2). It would have been obvious to one of ordinary skill in the art at the time the invention was made to include the capacitor, the switching element and other features as discussed above for performing power conversion.
