The specification has not been checked to the extent necessary to determine the presence of all possible minor errors. Applicant’s cooperation is requested in correcting any errors of which applicant may become aware in the specification.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-17 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claims 3 and 17 are rejected because it is not clear what constitutes normal temperature. Applicant has not defined this parameter in the specification.
A broad range or limitation together with a narrow range or limitation that falls within the broad range or limitation (in the same claim) may be considered indefinite if the resulting claim does not clearly set forth the metes and bounds of the patent protection desired. See MPEP § 2173.05(c). In the present instance, claim 1 recites the broad recitation the reaction temperature in the first zone is from 120 to 300 C, and the claim also recites preferably from 150 to 250 C which is the narrower statement of the range/limitation. The claim(s) are considered indefinite because there is a question or doubt as to whether the feature introduced by such narrower language is (a) merely exemplary of the remainder of the claim, and therefore not required, or (b) a required feature of the claims.
A broad range or limitation together with a narrow range or limitation that falls within the broad range or limitation (in the same claim) may be considered indefinite if the resulting claim does not clearly set forth the metes and bounds of the patent protection desired. In the present instance, claim 1 recites the broad recitation the reaction temperature in the second reaction zone is from 181 to 300 C, and the claim also recites preferably from 200 to 260 C which is the narrower statement of the range/limitation. In the present instance, claim 3 recites the broad recitation pretreating the liquid feed stream comprising endo-tetrahydrodicyclopentadiene with an adsorbent , and the claim also recites more preferably the conditions of the pretreatment of step 1) include: the temperature of from normal temperature to 60 C which is the narrower statement of the range/limitation. The claim(s) are considered indefinite because there is a question or doubt as to whether the feature introduced by such narrower language is (a) merely exemplary of the remainder of the claim, and therefore not required, or (b) a required feature of the claims.

The claim(s) are considered indefinite because there is a question or doubt as to whether the feature introduced by such narrower language is (a) merely exemplary of the remainder of the claim, and therefore not required, or (b) a required feature of the claims.

In the present instance, claim 6 recites the broad recitation a strong acid amount of from 150 to 850 µmol, and the claim also recites preferably from 370 to 700 µmol/g which is the narrower statement of the range/limitation. The claim(s) are considered indefinite because there is a question or doubt as to whether the feature introduced by such narrower language is (a) merely exemplary of the remainder of the claim, and therefore not required, or (b) a required feature of the claims.
The examiner has set forth multiple examples of a broad range or limitation together with a narrow range or limitation that falls within the broad range or limitation (in the same claim). Therefore, the examiner will not continue listing each and every range/limitation for the remaining claims, 7-17. As set forth above, a broad range or limitation together with a narrow range or limitation that falls within the broad range or limitation (in the same claim) may be considered indefinite if the resulting claim does not clearly set forth the metes and bounds of the patent protection desired. See MPEP § 2173.05(c). In the present instances, claims 7-17 recite several different broad recitations, and the claims also recite several different additional limitations which are the narrower statements of the ranges/limitations. The terms preferably, more preferably, further preferably and especially followed by a range or limitation renders the claims indefinite, as set forth above with claims 1-6 and here with claims 7-17 because there is a question or doubt as to whether the feature introduced by such narrower language is (a) merely exemplary of the remainder of the claims, and therefore not required, or (b) a required feature of the claims.
