Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Allowable Subject Matter
Claims 2-10 and 12-20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims and if the claim objections are addressed.
Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.
Claim 11-20 is directed to (A computer storage medium….). Giving its terms their broadest reasonable interpretation, the claim as a whole may be reasonably construed to encompass transitory media such as electromagnetic carrier waves. Transitory media are not a process, machine, manufacture, or composition of matter within the meaning of 35 USC 101. The Examiner recommends amending the claim to recite a “non-transitory storage medium” which follows the description in the specification.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
((a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1, and 11 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by “3GPP TSG-RAN WG4 Meeting #103-e; R4-2209689 ; Electronic Meeting, 9th – 20th May, 2022”,; referred as 3GPP.
Regarding claim 1 and 11, 3GPP discloses
1. An apparatus of a user equipment (UE) configured for operation in a fifth-generation (5G) new radio (NR) network, the apparatus comprising: processing circuitry; and memory,
wherein to configure the UE for Transmission-Reception Point (TRP) specific beam failure detection (BFD) and candidate beam detection (CBD) testing, the processing circuitry is configured to:
11. A computer-readable storage medium that stores instructions for execution by processing circuitry of a user equipment (UE) configured for operation in a fifth-generation (5G) new radio (NR) network, wherein to configure the UE for Transmission-Reception Point (TRP) specific beam failure detection (BFD) and candidate beam detection (CBD) testing, the processing circuitry is configured to:
synchronize the UE to a first cell and a second cell, the first cell being a primary cell (PCell), the second cell being a primary Secondary Cell (PSCell), the PSCell being an active serving cell for the UE; and
monitor signal levels of the PSCell within an active downlink bandwidth part (DL-BWP) for the BFD and the CBD testing during an evaluation period, the signal levels of the PSCell including: a signal-to-noise ratio (SNR) level of a reference signal received within a first beam set (q0,0) from a first TRP; a layer one (L1) Reference Signal Received Power (RSRP) (L1-RSRP) level of a reference signal received within a second beam set (q0,1) from the first TRP; and a SNR level of a reference signal received within a first beam set (q1,0) from a second TRP, wherein the memory is configured to store the SNR level of the reference signal received with the first beam set from the first TRP(A.4.5.5.X EN-DC Beam Failure Detection and Link Recovery Test for FR1 PSCell configured with CSI-RS-based BFD and LR and UE fulfilling relaxed measurement criterion A.4.5.5.X.1;Test Purpose and Environment: discloses the UE properly detects CSI-RS-based beam failure in the set q0 configured for a serving PSCell and that the UE performs correct CSI-RS-based link recovery based on beam candicate set q1. The UE tests the downlink monitoring for beam failure detection within the active DL BWP of the PSCell, during the evaluation period, This test will partly verify the relaxed CSI-RS based beam failure detection and link recovery for an FR1 serving cell requirements, wherein The test parameters are given in Tables A.4.5.5.X.1-1, A.4.5.5.X.1-2, A.4.5.5.X.1-3, and A.4.5.5.X.1-4 below, wherein there are two cells, cell 1 is the E-UTRAN PCell, and cell 2 is the PSCell, in the test. The test consists of five successive time periods, with time duration of T1, T2, T3, T4 and T5 respectively. Figure A.4.5.5.X.1-1 shows the variation of the downlink SNR of the PSCell and the SNR of the CSI-RS in set q0 in the active PSCell to emulate CSI-RS based beam failure. Figure A.4.5.5.X.1-1 additionally shows the variation of the downlink L1-RSRP of the CSI-RS in set q1 of the candidate beam used for link recovery. Prior to the start of the time duration T1, the UE shall be fully synchronized to cell 1 and cell 2. The UE shall be configured for periodic CSI reporting with a reporting periodicity of 5 ms. In the test, DRX configuration is enabled in PSCell and DRX inactivity timer has already been expired, i.e. UE tries to decode PDCCH and to send periodic CQI during the period when On-duration timer is running. Time alignment timers shall be set to “infinity” so that UL timing alignment is maintained during the test.
