Office Action

§101 §102 §103 §112 §DOUBLEPATENT
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Applicant’s claim for the benefit of a prior-filed application, PCT/CN2022/097413 filed 6-7-22, under 35 U.S.C. 119(e) or under 35 U.S.C. 120, 121, 365(c), or 386(c) is acknowledged. Information Disclosure Statement These information disclosure statements (IDS) submitted on 9-12-24, 7-10-25, 8-4-25 & 10-27-25. These submissions are in compliance with the provisions of 37 CFR 1.97. Accordingly, these information disclosure statements are being considered by the examiner. Drawings The drawings are objected to because All Numbers in Figure 1 should be labeled with descriptive legends. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Specification The lengthy specification has not been checked to the extent necessary to determine the presence of all possible minor errors. Applicant’s cooperation is requested in correcting any errors of which applicant may become aware in the specification. Claim Rejections - 35 USC § 101 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. Claim 13 is rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter. The Claims 13-15 & 18-19 do not fall within at least one of the four categories of patent eligible subject matter because claim 13 is directed a method, i.e., “a process is a series of acts or steps”{Minton v. Natl. Ass’n. of Securities Dealers, 336 F.3d 1373, 336 F.3d 1373, 1378, 67 USPQ2d 1614, 1681 (Fed.Cir. 2003), see also MPEP 2601.I-II.A-B & B(1)(a)}. In this case, claim 13 comprises only one sending step. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claims 1, 9, 12-15 & 18 are vague and indefinite because it is not clear whether the configuration update information sending by the first network node based on the received information related to handover? Likewise, claims 5 & 19 are vague and indefinite because it is not clear whether the sending response information by the first network node based on the received information related to handover? Also, claims 10-11 are vague and indefinite because it is not clear whether the receiving response message by the first network node based on the sending configuration update information. Dependent claims 2-4, 6-8, 12 and 16-17 & 20 are also rejected in virtue of their dependencies on the independent claims 1 and 15, respectively. Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being incomplete for omitting essential structural cooperative relationships of elements, such omission amounting to a gap between the necessary structural connections. See MPEP § 2172.01. The omitted structural cooperative relationships are: There is no interrelationship between the receiving of information related to handover from the third/second network node and the sending of configuration update information by the first network node {claims 1, 9, 13-15 & 18}; between the sending response information by the first network node (claim 5) and the received information related to handover (claim 1); between the receiving of response information from the third network node (claims 10-11) and the sending of configuration update information by the first network node (claim 1); between the receiving information related to the handover (claim 15) and the sending response information by the first node (claim 19). Dependent claims 2-4, 6-8, 12 and 16-17 & 20 are also rejected in virtue of their dependencies on the independent claims 1 and 15, respectively. Double Patenting The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b). The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13. The USPTO Internet website contains terminal disclaimer forms which may be used. Please visit www.uspto.gov/patent/patents-forms. The actual filing date of the application in which the form is filed determines what form (e.g., PTO/SB/25, PTO/SB/26, PTO/AIA /25, or PTO/AIA /26) should be used. A web-based eTerminal Disclaimer may be filled out completely online using web-screens. An eTerminal Disclaimer that meets all requirements is auto-processed and approved immediately upon submission. For more information about eTerminal Disclaimers, refer to www.uspto.gov/patents/apply/applying-online/eterminal-disclaimer. Claim(s) 1-20 are rejected on the ground of nonstatutory double patenting as being unpatentable over claim(s) 1, 6 & 10 of U.S. Patent No. 12,464,415 B2 (Luo) in view of Wang (US 20230109817 A1). Regarding Claim 1. A method, comprising: receiving, by a first network node {DU} from a second network node {CU}, information related to handover of a wireless communication device {UE} {Luo (US 12464415 B2): patented claims 1, 6 & 10}; and sending, by the first network node {DU} to a third network node {UE}, configuration update information {Luo (US 12464415 B2): patented claims 1, 6 & 10}. Luo does not explicitly disclose “configuration update information”. However, in the same field of endeavor, Wang (US 20230109817 A1) disclose “configuration update information”{Wang (US 20230109817 A1): ¶0357-¶0402, ¶0409-¶04013, ¶0438-¶0442, ¶0445-¶0452, ¶0458-¶0465, ¶0468-¶047}. Therefore, it would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to apply Wang’s teaching to Luo’s system with the motivation being to “handover of user equipment in a multi-hop network, and the disclosure relates to a device”{Wang (US 20230109817 A1): ¶0001} and “to update the configuration of users served by the relay node in the migration process of the relay node, and how to reduce signaling overhead in the configuration update process”{Wang (US 20230109817 A1): ¶0012}. Regarding Claim 2. Claim Rejections - 35 USC § 103 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claim(s) 2 & 16 is/are rejected under 35 U.S.C. 102(a)(1-2) as anticipated by Wang (US 20230109817 A1) or, in the alternative, under 35 U.S.C. 103 as obvious over Wang (US 20230109817 A1) in view of Ishii (US 2023/0164658 A1). As 102 rejection: Regarding Claim 2. The method of claim 1, wherein: the third network node (Wang: First Node, Fig.4) comprises an integrated access and backhaul (IAB) node; and the first network node (Wang: Second Node, Fig.4) comprises a target IAB donor, and the second network node (Wang: Third Node in Fig.4) comprises a source IAB donor; or the first network node (Wang: Second Node, Fig.4) comprises the source IAB donor, and the second network node (Wang: Third Node in Fig.4) comprises the target IAB donor {Wang (US 20230109817 A1): ¶0081-0084 wherein a first node is a relay node; second node is a source node, which may be an anchor node (donor node); and a third node is a target node, which may be an anchor node (donor node); and also Fig.1 & ¶0007 wherein all relay nodes and donor nodes are IAB nodes; In other words, first, second and third nodes are IAB nodes, emphasis added}. Regarding Claim 16. The first network node of claim 15, wherein: the third network node comprises an integrated access and backhaul (IAB) node; and the first network node comprises a target IAB donor, and the second network node comprises a source IAB donor; or the first network node comprises the source IAB donor, and the second network node comprises the target IAB donor. -Claim 16 is rejected with the same reasons as set forth in claims 1-2 & 15. As 103 rejection: Regarding Claim 2. With the same reasons as set forth in the method of claim 1, Wang does not explicitly disclose wherein: the third network node comprises an integrated access and backhaul (IAB) node; and the first network node comprises a target IAB donor, and the second network node comprises a source IAB donor; or the first network node comprises the source IAB donor, and the second network node comprises the target IAB donor. However, in the same field of endeavor, Ishii (US 2023/0164658 A1) wherein: the third network node comprises an integrated access and backhaul (IAB) node; and the first network node comprises a target IAB donor, and the second network node comprises a source IAB donor; or the first network node comprises the source IAB donor, and the second network node comprises the target IAB donor {Ishii: Figs.1 & 12 wherein all source, target/child and relay nodes are IAB nodes, ¶0156-¶0157; see also Fig.15}. Therefore, it would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to apply Ishii’s teaching to Wang’s system with the motivation being to “configure an IAB node or UE with a conditional handover with conditions for performing an autonomous handover to the cell served by the target node”{Ishii: ¶0165}. Regarding Claim 16. With the same reasons as set forth in the first network node of claim 15, wherein: the third network node comprises an integrated access and backhaul (IAB) node; and the first network node comprises a target IAB donor, and the second network node comprises a source IAB donor; or the first network node comprises the source IAB donor, and the second network node comprises the target IAB donor {Wang (US 20230109817 A1): ¶0081-0084 wherein a first node is a relay node; second node is a source node, which may be an anchor node (donor node); and a third node is a target node, which may be an anchor node (donor node); see also Fig.1 & ¶0007 wherein all relay nodes and donor nodes are IAB nodes}. The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Akl (US 11706690 B2) discloses in some aspects, an integrated access and backhaul (IAB) node may receive, from a first IAB donor centralized unit (CU) via a first parent distributed unit (DU), a first indication to establish a first connection with a second parent DU associated with a second IAB donor CU. The IAB node may establish the first connection with the second parent DU. The IAB node may establish a second connection with the first IAB donor CU via the second parent DU, the first connection and the second connection forming a target path between the IAB node and the first IAB donor CU {Figs.1-12}.
