DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The information disclosure statement (IDS) submitted on 09/12/2024; the submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Double Patenting The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b). The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. Claims 1, 7, and 13 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 7 and 18 of U.S. Patent No. 12114263. Although the claims at issue are not identical, they are not patentably distinct from each other because they site the terminal device detects a downlink control information of power saving in a first period where the DRX On Duration timer DCP and DCP indication associated with a DRX cycle to start DRX. Claims 3-4, 9-10, 15-17 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 7 and 18 of U.S. Patent No. 12114263 in view of US-10588171-B2 to Ang. Regarding claim 3 U.S. Patent No. 12114263 teaches…the method according to claim 1, further comprising: but does not teach…continuing running, by the terminal device, other DRX timers running in the first time period in a case that the other DRX timers have not stopped; wherein the other DRX timers comprise at least one of the following: a DRX downlink retransmission timer, a DRX uplink retransmission timer, a DRX short cycle timer, a DRX downlink hybrid automatic repeat request (HARQ) round-trip time timer, a DRX uplink HARQ round-trip time timer, and a random access contention resolution timer. Ang teaches… continuing running, by the terminal device, other DRX timers running in the first time period in a case that the other DRX timers have not stopped; wherein the other DRX timers comprise at least one of the following: a DRX downlink retransmission timer, a DRX uplink retransmission timer, a DRX short cycle timer, a DRX downlink hybrid automatic repeat request (HARQ) round-trip time timer, a DRX uplink HARQ round-trip time timer, and a random access contention resolution timer (Fig. 6, Col 17, Lns. 10-20 ). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the combination of U.S. Patent No. 12114263 by incorporating the teachings of Ang because the method and device allow for various modes of configuration of multi-state discontinuous reception (DRX) catering to the various time durations (Ang, Abs). The motivation is that by applying a well-known standard or protocol or machine to a system provides the system with significantly improved industrial applicability. (Original) A terminal device, comprising: a processor, configured to detect a wakeup signal in a first time period; wherein the processor is further configured to execute at least one of: starting a discontinuous reception (DRX) On Duration timer in a DRX cycle after the first time period in a case that the wakeup signal is detected and the wakeup signal is used to indicate that the terminal device starts the DRX On Duration timer in the DRX cycle after the first time period, or the terminal device does not detect the wakeup signal; and not starting the DRX On Duration timer in the DRX cycle after the first time period in a case that the wakeup signal is detected and the wakeup signal is used to indicate that the terminal device does not start the DRX On Duration timer in the DRX cycle after the first time period. The terminal device according to claim 7, wherein the processor is further configured to execute at least one of: continuing running a DRX inactivity timer running in the first time period in a case that the DCP and the DCP indication are detected, the DCP indication indicates that the terminal device starts the DRX On Duration timer in the DRX cycle after the first time period, and the DRX inactivity timer has not stopped; continuing running the DRX inactivity timer running in the first time period in a case that no DCP is detected and the DRX inactivity timer has not stopped; or, continuing running or stopping the DRX inactivity timer running in the first time period in a case that the DCP is detected, the DCP indicates that the terminal device does not start the DRX On Duration timer in the DRX cycle after the first time period, and the DRX inactivity timer has not stopped. A non-transitory computer readable medium storing a computer program which when executed by a processor of a terminal device, causes the processor to perform a method for discontinuous reception (DRX), comprising: detecting a DCP (Downlink Control Information of Power saving) in a first time period; wherein a DRX On Duration timer meets at least one of: in a case that the terminal device detects the DCP and DCP indication associated with a DRX cycle indicated to start the DRX On Duration timer in the DRX cycle, the DRX On Duration timer is started in the DRX cycle after the first time period; or, in a case that the terminal device does not detect the DCP, the terminal device does not start the DRX On Duration timer in the DRX cycle after the first time period. 18. The non-transitory computer readable medium according to claim 13, wherein the computer program, when executed by the processor, causes the processor to: continue running a DRX inactivity timer running in the first time period in a case that the terminal device detects the DCP and the DCP indication, the DCP indication indicates that the terminal device starts the DRX On Duration timer in the DRX cycle after the first time period, and the DRX inactivity timer has not stopped; continue running the DRX inactivity timer running in the first time period in a case that the terminal device does not detect the DCP and the DRX inactivity timer has not stopped; or, continue running or stop the DRX inactivity timer running in the first time period in a case that the terminal device detects the DCP, the DCP indicates that the terminal device does not start the DRX On Duration timer in the DRX cycle after the first time period, and the DRX inactivity timer has not been stopped. See Objection Allowable Subject Matter Claims 2, 6 8, 12, 14, and 18 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Furthermore,. US-10485052-B2 to Quan discloses multiple configuration supporting short and standard TTI; US-20160044654-A1 to Dalsgaard discloses stopping transmission during DRX and the short DRX timer is running; US-20170094713-A1 to Su teaches DRX cycle and wakeup periods but they do not read into the first information is used to indicate whether the terminal device starts the DRX On Duration timer in the DRX cycle after the first time period, and the second information is used to indicate whether to continue running or stop the DRX inactivity timer running in the first time period Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
