The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 103
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 1-3, 5-15 and 18-20 is/are rejected under 35 U.S.C. 103 as being unpatentable over Lee (20200177254) in view of Zhou (20210328711).
As per claim 1, Lee shows the use of a wireless transmit/receive unit (WTRU) comprising circuitry, including any of a transmitter, a receiver, a processor, and a memory (e.g., figure 1B), configured to: receive configuration information associated with one or more network coding generations (e.g., figure 11); determine that at least one condition to trigger a status report request is satisfied for at least one network coding generation (e.g., figure 11 and paragraph 6); send the status report request based on the at least one condition being satisfied for the at least one network coding generation (e.g., paragraph 80); receive a status report comprising information associated with the at least one network coding generation (e.g., paragraphs 80 and 92); and transmit at least one network coded packet generated using the at least one network coding generation based on the status report and the configuration information (e.g., figure 11 and paragraph 205). Lee does not specifically show, but Zhou does show wherein the at least one network coded packet comprises at least one additional network coded packet to be transmitted for the at least one network coding generation (e.g., abstract). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the invention of Lee with the above limitations of Zhou because it would provide for the recovery of lost data.
As per claim 2, Lee shows the use of the WTRU of claim 1, wherein a network coding generation comprises a set of source packets being coded together (e.g., paragraph 80).
As per claim 3, Lee shows the WTRU of any of claims 1 wherein the configuration information indicates any of (i) a network coding code rate, (ii) a number of network coded packets to be used to recover a network coding generation, (iii) a maximum number of transmissions of network coded packets per network coding generation, and (iv) a number of network coding generations between triggers of status report requests (e.g., paragraph 2).
As per claim 5, Lee shows the use of the WTRU of claim 1,wherein the at least one condition to trigger the status report request is satisfied in a case where a number of network coding generations transmitted since a previous status report has been requested, is above a threshold (e.g., paragraph 159).
As per claim 6, Lee does not show but Zhou does show the WTRU of claim 1, wherein the at least one condition to trigger the status report request is satisfied in a case where all network coded packets generated using the one or more network coding generations have been transmitted (e.g., paragraph 239). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the invention of Lee with the above limitations of Zhou because it would provide for the recovery of lost data.
As per claim 7, Lee shows the use of the WTRU of any of claim 1, wherein the at least one condition to trigger the status report request is satisfied in a case where a delay budget for the at least one network coding generation is less than a time bound (e.g., abstract).
As per claim 8, Lee shows the use of the WTRU of any of claim 1, wherein the status report request indicates the at least one network coding generation for which information is to be included in the status report (e.g., paragraphs 78 and 82).
As per claim 9, Lee does not show but Zhou does show the WTRU of claim 1, wherein the status report request indicates if a number of missing network coded packets is to be reported for at least one unrecovered network coding generation (e.g., paragraph 62). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the invention of Lee with the above limitations of Zhou because it would provide for the recovery of lost data.
As per claim 10, Lee does not show, but Zhou does show the WTRU of claim 1, wherein the status report request indicates if a number of extra network coded packets is to be reported for at least one recovered network coding generation, wherein the extra network coded packets have been received in addition to network coded packets used for recovering the at least one recovered network coding generation (e.g., abstract and paragraph 66). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the invention of Lee with the above limitations of Zhou because it would provide for the recovery of lost data.
As per claim 11, Lee shows the use of the WTRU of any of claim 1, wherein the status report request indicates a characteristic for which a number of received network coded packets is to be reported for the at least one network coding generation (e.g., paragraph 203).
As per claim 12, Lee does not show, but Zhou does show the use of the WTRU of claim 1, wherein the status report indicates a number of missing network coded packets for recovering the at least one network coding generation (e.g., paragraph 102). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the invention of Lee with the above limitations of Zhou because it would provide for the recovery of lost data.
As per claim 13, Lee does not show, but Zhou does show the WTRU of claim 1, wherein the at least one network coded packet comprises at least one already transmitted network coded packet that has not been indicated by the status report as missing (e.g., abstract). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the invention of Lee with the above limitations of Zhou because it would provide for the recovery of lost data.
As per claim 14, Lee shows the use of the WTRU of any of claim 1, wherein the status report indicates a new network coding code rate (e.g., paragraphs 80 and 92).
As per claim 15, Lee does not show, but Zhou does show the use of the WTRU of claim 14, further configured to update a network coding code rate to the new network coding code rate and to apply the new network coding code rate to any of the at least one network coding generation and a subsequent network coding generation (e.g., abstract). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the invention of Lee with the above limitations of Zhou because it would provide for the recovery of lost data.
As per claim 18, it is rejected for similar reasons as claim 1.
As per claim 19, it is rejected for similar reasons as claim 2.
As per claim 20, Lee shows the network element comprising circuitry, including any of a transmitter, a receiver, a processor, and a memory, configured to: send configuration information associated with one or more network coding generations; receive a plurality of network coded packets associated with at least one network coding generation; decode the plurality of network coded packets to recover the at least one network coding generation; receive a status report request (e.g., figures 1B and 11, paragraphs 6, 80, 92 and 205). Lee does not show, but Zhou shows the use of determine that at least one network coded packet is missing to recover the at least one network coding generation (e.g., paragraph 62); send a status report indicating a failure to recover the at least one network coding generation (e.g., paragraph 62); and receive at least one additional network coded packet associated with the at least one network coding generation, wherein the at least one additional network coded packet is not a retransmission of a missing network coded packet (e.g., abstract). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the invention of Lee with the above limitations of Zhou because it would provide for the recovery of lost data.
Claim(s) 4, 16 and 17 is/are rejected under 35 U.S.C. 103 as being unpatentable over Lee (20200177254) in view of Zhou (20210328711) and in further view of Leppanen (20040009771).
As per claim 4, Lee and Zhou do not show, but Leppanen does the WTRU of claim 3, wherein the maximum number of transmissions of network coded packets comprises any of a maximum number of retransmissions of network coded packets and a maximum number of transmissions of additional network coded packets (e.g., paragraphs 4 and 38). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the invention of Lee and Zhou with the above limitations of Leppanen because it would provide for more accuracy of the received data.
As per claim 16, Lee does not show, but Zhou shows the use of the WTRU of claim 1, further configured to: receive an indication that the at least one network coding generation has been recovered (e.g., paragraph 62). Lee and Zhou do not show, but Leppanen does show remove from a transmit buffer network coded packets associated with the at least one network coding generation (e.g., paragraphs 4 and 38). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the invention of Lee and Zhou with the above limitations of Leppanen because it would provide for more accuracy of the received data.
As per claim 17, Lee does not show, but Zhou does show the WTRU of claim 1, further configured to: receive an indication that the at least one network coding generation has been recovered (e.g., paragraph 62). Lee and Zhou do not show, but Leppanen does show and update a lower edge of a transmitting window to be a first network coded packet generated using a next network coding generation to be recovered (e.g., paragraphs 4 and 38). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the invention of Lee and Zhou with the above limitations of Leppanen because it would provide for more accuracy of the received data.
