Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 2, 4, and 7 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 2 recites the limitation "the mass percentage" in line 1. There is insufficient antecedent basis for this limitation in the claim.
Claim 4 recites the limitation "the mass ratio" in line 1. There is insufficient antecedent basis for this limitation in the claim.
Claim 4 recites the limitation "the ratio of the carbon nanotube to the deionized water" in lines 2-3. There is insufficient antecedent basis for this limitation in the claim.
Claim 7 recites the limitation "the ratio" in line 1. There is insufficient antecedent basis for this limitation in the claim.
Claim 7 recites the limitation "the mass ratio" in line 2. There is insufficient antecedent basis for this limitation in the claim.
Claim 7 recites the limitation "the mass ratio" in line 3. There is insufficient antecedent basis for this limitation in the claim.
Allowable Subject Matter
Claims 1, 3, 5, 6, and 8-10 are allowable over the prior art of record.
The following is a statement of reasons for the indication of allowable subject matter:
Currently, there is no prior art alone or in combination that teaches or fairly suggests a method for a resin-based composite nuclear shielding material comprising the steps of forming solutions A, B, and C as required in claim 1. Therefore, claim 1 is allowable over the prior art of record. Claims 3, 5, 6, and 8-10 depend from claim 1 are allowable based on their dependencies.
Claims 2, 4 and 7 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
