The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
Applicant’s election of group I in the reply filed on 06/10/2026 is acknowledged. Because applicant did not distinctly and specifically point out the supposed errors in the restriction requirement, the election has been treated as an election without traverse (MPEP § 818.01(a)).
Claims 7-10 are withdrawn from further consideration pursuant to 37 CFR 1.142(b), as being drawn to a nonelected group II, there being no allowable generic or linking claim. Applicant timely traversed the restriction (election) requirement in the reply filed on 06/10/2026.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-5 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Mochizuki et al. (US 2021/0001601).
Regarding claims 1-3, Mochizuki discloses a laminate (0072) comprising a resin protective layer 18 (fig. 5, 0127-0133), i.e. a first resin layer, an inorganic layer 14a or 14b (fig. 5, 0098), a substrate 12 comprising a resin (0102), i.e. a second resin layer, wherein a mixed layer 15 is provided between the first resin layer and the inorganic layer and between the second resin layer and the inorganic layer (fig. 5, 0077). Given that the inorganic layer is a continuous layer in fig. 5, it is clear that there is no voids in the layer and therefore the void ratio is 0.
Regarding claim 3, Mochizuki discloses the laminate of claim 1, wherein the mixed layer has a thickness of 3 nm or more (abstract).
Regarding claims 4-5, Mochizuki discloses the laminate of claim 1, wherein the inorganic layer contains silicon dioxide (0120).
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 6 is/are rejected under 35 U.S.C. 103 as being unpatentable over Mochizuki et al. (US 2021/0001601).
Regarding claim 6, Mochizuki discloses the laminate of claim 1, wherein the inorganic layer has a thickness of 5 nm (0029).
As set forth in MPEP 2144.05, in the case where the claimed range “overlap or lie inside ranges disclosed by the prior art”, a prima facie case of obviousness exists, In re Wertheim, 541 F.2d 257, 191 USPQ 90 (CCPA 1976); In re Woodruff, 919 F.2d 1575, 16 USPQ2d 1934 (Fed. Cir. 1990).
