DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Specification The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed. The following title is suggested: IMAGE FORMING APPARATUS, METHOD OF CONTROLLING IMAGE FORMING APPARATUS, AND STORAGE MEDIUM COMPRISING DETERMINING WHETHER TO STORE DATA IN A FIRST STORAGE UNIT OR A SECOND STORAGE UNIT WHEN DETECTING A RECEIVED FORMAT OF THE PRINT DATA. Claim Interpretation The following is a quotation of 35 U.S.C. 112(f): (f) Element in Claim for a Combination. – An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. The following is a quotation of pre-AIA 35 U.S.C. 112, sixth paragraph: An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. The claims in this application are given their broadest reasonable interpretation using the plain meaning of the claim language in light of the specification as it would be understood by one of ordinary skill in the art. The broadest reasonable interpretation of a claim element (also commonly referred to as a claim limitation) is limited by the description in the specification when 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is invoked. As explained in MPEP § 2181, subsection I, claim limitations that meet the following three-prong test will be interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph: (A) the claim limitation uses the term “means” or “step” or a term used as a substitute for “means” that is a generic placeholder (also called a nonce term or a non-structural term having no specific structural meaning) for performing the claimed function; (B) the term “means” or “step” or the generic placeholder is modified by functional language, typically, but not always linked by the transition word “for” (e.g., “means for”) or another linking word or phrase, such as “configured to” or “so that”; and (C) the term “means” or “step” or the generic placeholder is not modified by sufficient structure, material, or acts for performing the claimed function. Use of the word “means” (or “step”) in a claim with functional language creates a rebuttable presumption that the claim limitation is to be treated in accordance with 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. The presumption that the claim limitation is interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is rebutted when the claim limitation recites sufficient structure, material, or acts to entirely perform the recited function. Absence of the word “means” (or “step”) in a claim creates a rebuttable presumption that the claim limitation is not to be treated in accordance with 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. The presumption that the claim limitation is not interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, is rebutted when the claim limitation recites function without reciting sufficient structure, material or acts to entirely perform the recited function. Claim limitations in this application that use the word “means” (or “step”) are being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, except as otherwise indicated in an Office action. Conversely, claim limitations in this application that do not use the word “means” (or “step”) are not being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, except as otherwise indicated in an Office action. This application includes one or more claim limitations that do not use the word “means,” but are nonetheless being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, because the claim limitation(s) uses a generic placeholder that is coupled with functional language without reciting sufficient structure to perform the recited function and the generic placeholder is not preceded by a structural modifier. Such claim limitation(s) is/are: FIRST STORAGE UNIT, SECOND STORAGE UNIT, RECEPTION UNIT AND CONTROL UNIT in claims 1-12. Because this/these claim limitation(s) is/are being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, it/they is/are being interpreted to cover the corresponding structure described in the specification as performing the claimed function, and equivalents thereof. If applicant does not intend to have this/these limitation(s) interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, applicant may: (1) amend the claim limitation(s) to avoid it/them being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph (e.g., by reciting sufficient structure to perform the claimed function); or (2) present a sufficient showing that the claim limitation(s) recite(s) sufficient structure to perform the claimed function so as to avoid it/them being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. Claim Rejections - 35 USC § 103 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows: 1. Determining the scope and contents of the prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or nonobviousness. Claim(s) 1-11 is/are rejected under 35 U.S.C. 103 as being unpatentable over Lin (US Pub 2015/0153986) in view of Iida (US Pub 2022/0156020). Re claim 1: Lin discloses an image forming apparatus comprising: a first storage unit (interpretation: The forced hold region 301 is a storage region in which print data received from the PC 102 is temporarily stored in a case where the image forming apparatus 101 is set to operate in the forced hold mode, which is taught in ¶ [43]. This interpretation and its equivalents are utilized for the claim term hereinafter in the Office Action.) configured to store print data, a print setting of the print data being unchangeable by a user (e.g. the forcible reservation area is considered as the first storage unit area that print data and print settings that are not changeable by a user since an authentication of the data is applied in order to print the data. This is taught in ¶ [48].); [0047] FIG. 4 is a conceptual view illustrating sections of storage areas provided in the HDD 204. The HDD 204 includes a forcible reservation area 1101, a box area 1102, and the other area 1103. [0048] The forcible reservation area 1101 serves as, when the MFP 102 is set to operate in the forcible reservation mode, a storage area for temporarily storing print data received from the PC 101. An instruction to print the print data stored in the forcible reservation area 1101 can be issued, in view of security, only by a user authenticated by an authentication unit (IC card authentication, or keyboard authentication). In other words, the image generating unit 813 provides an instruction for the size and count by type of sheets used in a print process to the sheet count program 409, and executes a process of forming an image of intermediate data (not shown) generated after analysis on the printing unit 815. The inspection unit 214 executes a process of inspecting an image generated on a sheet by the printing unit 815 and registers the result in the quality report creation unit 817. Therefore, in view of Iida, it would have been obvious to one of ordinary skill before the effective filing date of the claimed invention was made to have the feature of a second format, incorporated in the device of Lin, in order to determine whether JDF data is received and make changes to the JDF data to make sure correct settings are received, which improves the inspection of the data and ensures correct data is used (as stated in Iida ¶ [60]). Re claim 2: However, Lin fails to specifically teach the features of the image forming apparatus according to claim 1, wherein the second format is a job definition format (JDF). However, this is well known in the art as evidenced by Iida. Similar to the primary reference, Iida discloses determining if JDF is received (same field of endeavor or reasonably pertinent to the problem). Iida discloses wherein the second format is a job definition format (JDF) (e.g. the system discloses determining if JDF is received in the system and stores the JDF data in a specific area for the JDF data to be stored, which is taught in ¶ [91] above.). Therefore, in view of Iida, it would have been obvious to one of ordinary skill before the effective filing date of the claimed invention was made to have the feature of wherein the second format is a job definition format (JDF), incorporated in the device of Lin, in order to determine whether JDF data is received and make changes to the JDF data to make sure correct settings are received, which improves the inspection of the data and ensures correct data is used (as stated in Iida ¶ [60]). Re claim 3: Lin discloses the image forming apparatus according to claim 1, wherein, in a case where the mode is not set, the control unit is configured to execute printing of the print data received by the reception unit without accepting the print instruction from the user (e.g. when a forced reservation mode is not set, print data is output without receiving an instruction from a user, which is taught in ¶ [63] and [64].). Each of the first inspection unit 907 and the second inspection unit 908 each made up of the contact image sensor continuously reads an image on the sheet conveyed to the conveying path 906 in the main scanning direction in step with the conveying speed of the sheet and highly accurately acquires planar image information formed on a sheet. In other words, the first inspection unit 907 and the second inspection unit 908 are capable of detecting defects of an image, such as misregistration of an image and a stain, of image information formed on a sheet, and inspecting an image, such as the reading accuracy of a barcode. Therefore, in view of Iida, it would have been obvious to one of ordinary skill before the effective filing date of the claimed invention was made to have the feature of wherein the print setting is a setting of a number of copies, incorporated in the device of Lin, in order to determine whether JDF data is received and make changes to the JDF data to make sure correct settings are received, which improves the inspection of the data and ensures correct data is used (as stated in Iida ¶ [60]). Re claim 5: However, Lin fails to specifically teach the features of the image forming apparatus according to claim 1, wherein the print setting is a setting of stapling. However, this is well known in the art as evidenced by Iida. Similar to the primary reference, Iida discloses determining if JDF is received (same field of endeavor or reasonably pertinent to the problem). Iida discloses wherein the print setting is a setting of stapling (e.g. the system discloses changing the number of copies, the stapling of documents, forming an image on both sides of a document or changing paper type, which is taught in ¶ [155], [156], [94] and [95]. In addition, this can be applied to a partial aspect of the document or whole document.). Therefore, in view of Iida, it would have been obvious to one of ordinary skill before the effective filing date of the claimed invention was made to have the feature of wherein the print setting is a setting of stapling, incorporated in the device of Lin, in order to determine whether JDF data is received and make changes to the JDF data to make sure correct settings are received, which improves the inspection of the data and ensures correct data is used (as stated in Iida ¶ [60]). Re claim 6: However, Lin fails to specifically teach the features of the image forming apparatus according to claim 1, wherein the second storage unit is configured to be capable of changing a print setting of a whole of the stored print data and changing a print setting of partial pages of the stored print data. However, this is well known in the art as evidenced by Iida. Similar to the primary reference, Iida discloses determining if JDF is received (same field of endeavor or reasonably pertinent to the problem). Iida discloses wherein the second storage unit is configured to be capable of changing a print setting of a whole of the stored print data and changing a print setting of partial pages of the stored print data (e.g. the system discloses changing the number of copies, the stapling of documents, forming an image on both sides of a document or changing paper type, which is taught in ¶ [155], [156], [94] and [95]. In addition, this can be applied to a partial aspect of the document or whole document.). Therefore, in view of Iida, it would have been obvious to one of ordinary skill before the effective filing date of the claimed invention was made to have the feature of wherein the second storage unit is configured to be capable of changing a print setting of a whole of the stored print data and changing a print setting of partial pages of the stored print data, incorporated in the device of Lin, in order to determine whether JDF data is received and make changes to the JDF data to make sure correct settings are received, which improves the inspection of the data and ensures correct data is used (as stated in Iida ¶ [60]). Re claim 7: However, Lin fails to specifically teach the features of the image forming apparatus according to claim 6, wherein the print setting of the partial pages of the print data is a setting of a type of paper to be used in printing. However, this is well known in the art as evidenced by Iida. Similar to the primary reference, Iida discloses determining if JDF is received (same field of endeavor or reasonably pertinent to the problem). Iida discloses wherein the print setting of the partial pages of the print data is a setting of a type of paper to be used in printing (e.g. the system discloses changing the number of copies, the stapling of documents, forming an image on both sides of a document or changing paper type, which is taught in ¶ [155], [156], [94] and [95]. In addition, this can be applied to a partial aspect of the document or whole document.). However, this is well known in the art as evidenced by Iida. Similar to the primary reference, Iida discloses determining if JDF is received (same field of endeavor or reasonably pertinent to the problem). Iida discloses wherein the print setting of the partial pages of the print data is a setting of double-sided print (e.g. the system discloses changing the number of copies, the stapling of documents, forming an image on both sides of a document or changing paper type, which is taught in ¶ [155], [156], [94] and [95]. In addition, this can be applied to a partial aspect of the document or whole document.). Therefore, in view of Iida, it would have been obvious to one of ordinary skill before the effective filing date of the claimed invention was made to have the feature of wherein the print setting of the partial pages of the print data is a setting of double-sided print, incorporated in the device of Lin, in order to determine whether JDF data is received and make changes to the JDF data to make sure correct settings are received, which improves the inspection of the data and ensures correct data is used (as stated in Iida ¶ [60]). Re claim 9: Lin discloses the image forming apparatus according to claim 6, wherein the print setting of the partial pages of the print data is a setting of image processing (e.g. the user can set for enlargement or reduction of the sheet within the job, which is seen in figure 12 and taught in ¶ [71] above.).
