CTNF 18/891,060 CTNF 85764 Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 102 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15 AIA Claim s 1, 2, 4, 5, 7, 9, 15, 23 and 24 are rejected under 35 U.S.C. 102( A)(1 ) as being anticipated by Hirao et al. (US Pub. No. 2010/0134905 A1) . As to claims 1 and 24, Hirao ‘905 shows an optical system (Fig. 4 and paras. 183 – 190) comprising a first lens group (L1, LS1, Fig. 4 and para. 185), an aperture stop ape (Fig. 4 and para. 185), and a rear group (L3, LS2, L4) in order from an object side (Fig. 4 and paras. 183 – 190), the rear group including a first cemented lens comprising a positive lens and a negative lens (Fig. 4 and para. 134), the optical system satisfying the following conditional expressions. 0.35<Bf/y<0.7 1.35<TL/y<2. 0.05<Np1-Nn1<0.4 where Bf: back focal length in air y: maximum image height TL: the distance from a lens surface closest to the object side to an image plane Np1: the refractive index of the positive lens constituting the first cemented lens Nn1: the refractive index of the negative lens constituting the first cemented lens (Fig. 4, Table 7 and para. 239). As to claim 2, Hirao ‘905 shows that the following conditional expression is satisfied. 1.5<tp1/tn1<7. where tp1: the central thickness of the positive lens constituting the first cemented lens tn1: the central thickness of the negative lens constituting the first cemented lens (Fig. 4, Table 7 and para. 239). As to claim 4, Hirao ‘905 shows that the following conditional expression is satisfied. 3.<vdp2-vdn2<30. where vdp1: the Abbe number based on d-line of the positive lens constituting the first cemented lens vdn1: the Abbe number based on d-line of the negative lens constituting the first cemented lens (Fig. 4, Table 7 and para. 239). As to claim 5, Hirao ‘905 shows that the rear group includes a second cemented lens that comprises a positive lens and a negative lens, and that differs from the first cemented lens (Fig. 4, paras. 134 and 183 – 190). As to claim 7, Hirao ‘905 shows that, among the first and second cemented lens, one cemented lens disposed on the object side has the negative lens on the object side, and the other cemented lens disposed on the image plane side has the negative lens on the image plane side (Fig. 4, paras. 134 and 183 – 190). As to claim 9, Hirao ‘905 shows that the following conditional expression is satisfied. 0.05<Np2/Nn2<0.400 where Np2: the refractive index of the positive lens constituting the second cemented lens Nn2: the refractive index of the negative lens constituting the second cemented lens (Fig. 4, Table 7 and para. 239). As to claim 15, Hirao ‘905 shows that the following conditional expression is satisfied. 0.13<tR/ƩD<0.350 where tR: the central thickness of a lens closest to the image plane side ΣD: the distance from the lens surface closest to the object side to a lens surface closest to the image plane side (Fig. 4, Table 7 and para. 239). As to claim 23, Hirao ‘905 shows an optical apparatus comprising the optical system according to claim 1 (see rejection for claim 1) . 07-15 AIA Claim 3 is rejected under 35 U.S.C. 102( A)(1 ) as being anticipated by Hirao et al. (US Pub. No. 2011/0001865 A1) . As to claim 3 , Hirao ‘865 shows an optical system comprising a first lens group (Fig. 2 and paras. 176 – 184), an aperture stop ape (Fig. 4 and para. 176), and a rear group (L3, LS2, L4) in order from an object side (Fig. 2 and paras. 176 – 184), the rear group including a first cemented lens comprising a positive lens and a negative lens (Fig. 2 and para. 138), the first lens group including a positive lens disposed closest to the object side (Fig. 2 and para. 138), the optical system satisfying the following conditional expressions. 1.<f/y<1.6 0.025<t1/f<0.08 where f: the focal length of the optical system y: maximum image height t1: the central thickness of the lens closest to the object side (Fig. 2, Table 3 and para. 233) . Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim s 6, 8, 10 – 14 and 16 – 22 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
