DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-8 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Choi et al (2026/0255198).
Regarding claims 1, 5, and 7, Choi discloses a communication apparatus and a method, comprising: in response to determining a terminal device (see UE in figures 5 and 10) fails to perform a handover to a first cell (target in figure 10), establishing a communication connection to a second cell (source in figure 10) managed by an access network device (see the connection between source and the terminal in figure 10) (see DAPS (dual active protocol stack) handover failure in paragraph 0172. Note that in DAPS handover, connection between the source and the terminal remain active to transmit and receive data); and sending a report to the access network device (see initiate the failure information procedure to report DAPS handover failure in paragraph 0172), wherein the report indicates that the terminal device fails to perform the handover to the first cell (see In order for the network (NW) to collect data for SON, the UE stores the failure related information into a SON related report (e.g., VarRLF-report and/or RLF-report in VarRLF-report) when the UE detects a connection failure such as radio link failure (RLF) and handover failure (HOF) in paragraph 0373), and the report comprises indication information that indicates the handover of the terminal device to the first cell is triggered by a service or by signal coverage quality (see If a mobility condition of a target cell informs a measurement ID which is related to a report configuration, the mobility condition of the target cell may be a condition (e.g., event A3 condition or event A5 condition) specified/indicated by a conditional reconfiguration triggering configuration (i.e., CondTriggerConfig) in the report configuration. The conditional reconfiguration triggering configuration may further specify/indicate a type of reference signal to measure for evaluating the mobility condition in paragraph 0143).
Regarding claims 2, 6, and 8, Choi discloses wherein the indication information further indicates whether the terminal device selects a cell that meets a condition (see UE cell selection and reselection and control of cell selection and reselection, inter-RAT mobility); QoS management functions; UE measurement reporting and control of the reporting; detection of and recovery from radio link failure in paragraphs 0110, 0127-0128).
Regarding claims 3 and 4, claims 3 and 4 claim a method that is a reverse process of the method described in claims 1 and 2. Claims 3 and 4 are, therefore, subject to the same rejection.
