Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 5, 8-9, 16 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
As to claims 5, 16, the claims recited wherein a main body in which the upper module and the lower module are combined has a shape of “describing as drawing in claim 5, 16” having protruding parts on opposite sides when viewed from above.
It is not clear in the describing in claims. Does It mean the upper module and the lower module are offset or something else in combination?
As to claims 8-9, the claims recited a first cylindrical wall standing upright in a shape of a square cylinder surrounding “a 1-1 contact area” and “a 2-1 contact area; also, a square cylinder surrounding a 1-2 contact area and a 2-2 contact area
It is not clear in the describing in claims and in the specification. Does It support in the specification and drawing?
Appropriate correction is required.
Allowable Subject Matter
Claims 1-4, 6-7, 10-15, 17-19 allowed.
The following is a statement of reasons for the indication of allowable subject matter:
As to claims 1-4, 6-7, 10-15, 17-19, the present invention is direct to a split-type measurement device: Independent claims 1, 2 identify the uniquely distinct features of “a second annular core configured to form a closed magnetic circuit around a second power line and consisting of a second upper core and a second lower core;"
The closest prior art, Berkcan et al. (US 20020011832 A1) and McBee et al. (US 9000875 B2) discloses conventional apparatus, either singularly or in combination, fail to anticipate or render the above underlined limitations obvious.
The other claims depend on independent claim is allowed as the same reasons above.
